Description/Analysis

IssueDetail

Issue Detail: The applicant for the vacation of a public roadway easement, submitted under Application No. VAC23-0001 with the Department of Public Works, has requested an additional one-year extension to complete the condition of vacation identified in Section 3 of Resolution No. 2023-0171. The resolution provides a two-year period to satisfy the required condition, which is set to expire on May 31, 2025, after which the resolution becomes void unless extended by the City Council.

City Council previously approved a one-year extension through Resolution No. 2025-0099, extending the  condition of vacation to May 31, 2026. The applicant has submitted the required materials to the Department of Public Works to complete the condition; however, the necessary elements will not be finalized prior to the current expiration date.

Policy Considerations: The Council action recommended in this report is consistent with the General Plan and Streets and Highways Code upon which Resolution No. 2023-0171 was approved.

EnvironmentalConsiderations

Environmental Considerations: The Community Development Department, Environmental Planning Services Division has reviewed this vacation/abandonment of the public highway easement and determined that this is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15305, as a Minor Alteration in Land Use Limitation.  The project consists of the minor alteration in land use limitations with an average slope of less than 20%, which does not result in any changes in land use or density.

Rationale for Recommendation: Approval of the requested second time extension is necessary to complete the vacation and to provide additional time for the applicant to satisfy the condition required under Resolution No. 2023-0171. Staff has reviewed the request and recommends that the City Council approve a second, one-year extension to allow completion of the vacation condition identified in Section 3 of Resolution No. 2023-0171.End
