Description/Analysis
IssueDetail
Issue Detail: In November of 2016, voters approved Proposition 64, the Control, Regulate and Tax Adult Use of Marijuana Act (AUMA). AUMA legalized the recreational use of marijuana in California for individuals 21 years of age and older and instituted taxes on cannabis. Proposition 64 also established the Public Health and Safety Grant Program which provides funding to support law enforcement, fire protection, and public health initiatives for jurisdictions that allow storefront cannabis retail sales or jurisdictions with fewer than 10,000 residents which allow cannabis delivery. The City qualifies and is eligible for this grant due to Council’s establishment of Storefront Cannabis Dispensary Permits (Ordinance 2017-0060) under City Code Section 5.150.350.
The Board of State and Community Corrections (BSCC) is the administering entity for this grant program, and has set a March 30, 2026 deadline to apply for Cohort 4 funds, with a total of $125 million available statewide. These funds can be used between July 1, 2026, and December 31, 2031. The City has applied for and received funding in prior Cohorts with the City receiving $3,999,470 over 2 grant cycles.
The Office of Cannabis Management convened the City’s Police, Community Development, and Youth, Parks, and Community Enrichment Departments to develop a plan regarding how Cohort 4 funding could best be utilized. Staff recommends the City apply for $6 million for the following:
• $4.2M to support public safety and enforcement, including support for Police Department and Code Enforcement staffing to enhance enforcement and public safety operations as well as contracts with Community-Based Organizations to identify, investigate, disrupt, and deter illicit commercial cannabis activity.
• $1.3M to support public health and youth development, prevention, and intervention, including support for the Office of Cannabis Management and the Department of Youth, Parks, and Community Enrichment to protect community safety, improve health outcomes, and reduce harms associated with cannabis activity and to improve outcomes for youth by implementing programs that prevent substance use, promote healthy decision making, and build the competencies needed for successful transition into adulthood.
There is no local match requirement for this grant, and grant funds cannot be used to supplant existing local funding that is already appropriated for the same purpose.
The BSCC grant funds will be used to reduce the prevalence of illicit commercial cannabis operations, improve community safety, promote education and outreach related to cannabis impacts especially in diverse populations, reduce youth cannabis use and promote youth engagement in school, family and community.
Approval of the attached resolution includes the State-mandated language authorizing the City Manager or designee to execute all necessary documents to apply for BSCC grant funds (Attachment 2).
