Additional Description/Analysis

IssueDetail

Issue Detail: The California Department of Resources Recycling and Recovery (CalRecycle) established the Senate Bill (SB) 1383 Local Assistance Grant Program to provide funding to local jurisdictions to assist with the implementation of regulation requirements associated with SB 1383 and organic waste diversion. CalRecycle requires the governing body of the grantee to maintain a resolution authorizing the signature authority to execute all documents necessary to apply for the program, accept funds, and maintain the grant through the grant term.

On November 14, 2023, City Council approved Resolution 2023-0349, authorizing the Department of Public Works, Recycling and Solid Waste Division (RSW) to apply for the grant for the estimated grant funding available to the City in an amount of $864,034. CalRecycle awarded the City $1,349,680 in funding and on March 14, 2024, City Council approved Resolution No. 2024-00741 to accept the increased award amount. The grant was set to expire by April 1, 2026, and the City Manager’s signatory authority to execute all documents necessary to apply for the program, accept funds, and maintain the grant extended through April 1, 2026, unless otherwise extended. Prior to April 1, 2026, CalRecycle extended the grant expiration date for all grantees to November 2, 2026, to allow additional time for project activities to be completed.

On September 24, 2026, CalRecycle notified all grantees that an additional grant term extension was available. On September 28, 2026, the City requested a grant term extension to fully expend the award due to delays in project implementation outside of the City’s control. To maintain Signature Authority and extend the grant term, staff is bringing forth this Resolution to amend the grant term end date to November 1, 2027, and to continue authorization of City Manager or designee signatory authority as required by CalRecycle’s grant policies.

PolicyConsiderations

Policy Considerations: The recommendations in this report are consistent with the City’s General Plan waste diversion goal to encourage recycling and composting to divert organic material from being sent to landfills, and the City’s Climate Action Plan’s strategy to reduce the amount of organic waste sent to landfills and decrease the City’s methane emissions generated by waste.

EconomicImpacts

Economic Impacts: None.

EnvironmentalConsiderations

Environmental Considerations:

California Environmental Quality Act (CEQA): No environmental review is necessary because the recommendations in this report involve administrative activity and are not considered to be a project in accordance with Section 15378(b)(2) of the CEQA Guidelines.

End

Sustainability

Sustainability: Through funding provided by the SB 1383 Local Assistance Grant Program, the City offers residents free recycled compost, created from the organic waste collected weekly from residents. Compost provides nutrients and temperature regulation to plants, improves water retention, and prevents erosion.

Commission/Committee Action: None.

RationaleforRecommendation

Rationale for Recommendation: CalRecycle requires the governing body of the applicant to maintain a valid Resolution authorizing the Signature Authority to execute all grant documents necessary. An updated resolution would allow the City to extend the grant term expiration date and expend remaining grant funds.

End

FinancialConsiderations

Financial Considerations:  Approving the Resolution would allow the City to fully expend the grant funds awarded through the SB 1383 Local Assistance Grant Program (G15003300, Solid Waste Grant Fund 6207).
