Description/Analysis
IssueDetail
Issue Detail: Staff recommends Council approve Supplemental Agreement No. 3 with Kjeldsen, Sinnock & Neudeck Inc. (KSN), for performing additional seepage and slope stability analyses and Master Plan review for existing detention basins under variable hydraulic conditions to support levee accreditation and minimize the area that may be mapped into the floodplain by FEMA.
End
PolicyConsiderations
Policy Considerations: The proposed supplemental agreement exceeds the City Manager’s approval authority, requiring Council approval.

EconomicImpacts
Economic Impacts: None.
End
EnvironmentalConsiderations
Environmental Considerations: This project was determined to be exempt from the requirements of the California Environmental Quality Act (CEQA), under CEQA Guidelines Section 15306, Information Collection. The project consists of basic data collection, research and resource evaluation activities which do not result in a serious or major disturbance to an environmental resource.
End
Sustainability
Sustainability: The proposed project is consistent with the 2040 General Plan Goal ERC-6 as it aims to reduce flood risk for life and property and Action PFS-A.4 as it identifies facilities needed to prevent structure flooding for the 100-year event.

Commission/Committee Action
Commission/Committee Action: Not applicable.

RationaleforRecommendation
Rationale for Recommendation: The scope of work covered under Supplemental Agreement No.3 builds on the prior supplemental agreements in the effort to close data gaps that were identified in the original contract. Supplemental No.2 increased the contract amount by $43,500 which did not require Council approval and became effective 09/13/2023. This Supplemental No.3 increases the contract amount by $20,526 and requires Council approval because the combined increase by Supplemental No.2 and No.3 ($64,026) exceeds 10% of the original contract value ($46,981), which supersedes the spending authority of the original contract.
The request for this supplemental agreement is a result of KSN’s subcontractor performing work that was above the original contract’s scope and budget. DOU staff met with KSN and their subcontractor and negotiated the budget to be added to the contract through this supplemental agreement, since the work performed is necessary to document any potential geotechnical deficiencies for portions of the Natomas interior levee system along the East Drainage Canal, B Drain and C-1 Drain.
End
FinancialConsiderations
Financial Considerations: The original not-to-exceed amount of the agreement was $469,810. The net change by previous supplemental agreements in the amount of $943,173 increased the agreement not-to-exceed amount to $1,412,983. The proposed Supplemental Agreement No. 3, in the amount of $20,526, would increase the agreement not-to-exceed amount to $1,433,509. Sufficient funds are available in the Flood Control Planning Project (I14010100, Fund 6011) to execute the agreement.
There are no General Funds allocated or planned for this project.
