Description/Analysis

IssueDetail

Issue Detail: The City of Sacramento operates an open, non-exclusive franchise system for commercial hauling. This system allows several haulers to compete and provide waste services to the commercial sector which includes businesses, multi-family properties of five units or more, as well as construction and demolition projects. Haulers must receive a franchise from the City to operate. Section 13.24.090 of the City Code provides that the City Council may grant an applicant a non-exclusive franchise to collect, transport, or dispose of solid waste materials that are kept, have accumulated, or been generated in the city. Non-exclusive franchise agreements are valid for up to 1-year with up to four (4) optional 1-year extensions. These agreements require City Council approval at least once every five years, and 2026 is the five-year mark.

 

On January 27, 2026, the City Council adopted changes to the City Code which created an option for a separate franchise agreement for full-service haulers versus Construction and Demolition (C&D) only haulers. The purpose was to simplify the Construction and Demolition franchise agreements and revise sections of the code so that franchisees who only haul construction and demolition materials (C&D) are not required to submit reports that pertain to full-service haulers who provide garbage, recycling, and organics service to commercial businesses and multi-family properties. This update allowed Recycling & Solid Waste to have the option of using separate franchise agreement forms, one for C&D and one for full-service haulers. 

 

For both full-service and construction and demolition (C&D) only haulers, the City’s franchise hauler application and approval process includes a financial and legal background review, documentation of adequate insurance, and diversion plans.

Policy Considerations: The recommendations of this report comply with Sacramento City Code chapter 13.24, which requires that a franchise agreement be in place for a hauler to collect commercial waste within the City.

Sustainability: As part of their application process, haulers must describe in detail how they will divert waste from landfills and educate customers on source separation and recycling.
