Description/Analysis
IssueDetail
Issue Detail: Staff recommends City Council approve Contract Amendment No. 15 with Peterson Brustad, Inc. for additional engineering support services during construction, and Contract Amendment No. 1 with 4LEAF, Inc. for an extension to the construction inspection and management services already being provided. Both amendments are required due to the extension to the contractor’s schedule on the Sump 89 Outfall Replacement Project. The design and construction inspection services are necessary because city staff do not have the specialized expertise needed to perform the required environmental monitoring and civil and structural engineering during construction, and city inspectors are not available to oversee this construction project, which requires full-time inspection.

PolicyConsiderations
Policy Considerations: Both the proposed contract amendments exceed the City Manager’s approval authority thus requiring Council approval per City Code 3.04.020.
End
EconomicImpacts
Economic Impacts: There are no economic impacts for the contract amendments.
End
EnvironmentalConsiderations
Environmental Considerations: Pursuant to the requirements of the California Environmental Quality Act (CEQA), the Sump 89 Outfall Replacement project was reviewed and evaluated through an Initial Study/ Mitigated Negative Declaration (IS/MND) that was adopted by City Council on August 10, 2021 (Resolution No. 2021-0245). The actions described in this report are administrative activities related to project agreements that are a component of the previously approved project. No additional environmental review is required.
End
Sustainability
Sustainability: The proposed project aligns with 2040 General Plan policy PFS-3.1 by improving pumping capacity for peak storm flows, which will improve service and infrastructure reliability, and increase system redundancy. It also supports PFS-2.2 by protecting and maintaining critical infrastructure through replacement of damaged and substandard drainage outfall pipes with current standard materials and upgrading the levee accordingly.

RationaleforRecommendation
Rationale for Recommendation: The Department of Utilities (DOU) owns, operates, and maintains 106 drainage sump stations within the city. The outfalls from the sump stations are the single point of discharge for storm water from their respective basins. The outfall pipes penetrate and cross major levees along the Sacramento River, American River, Natomas East Main Drainage Canal, Arcade Creek, and Morrison Creek.
City staff are required to inspect all pump outfall pipes that penetrate and cross major levees on a 5-year cycle as mandated by the US Army Corps of Engineers (USACE). During inspection of these outfalls, some were noted to be in failing condition or in danger of imminent failure. Inspection of Sump 89 outfall pipes revealed several holes and severe corrosion that necessitated replacement. Peterson Brustad, Inc. was hired to provide design services for replacements of these pipes (along with those at five other sump stations, of which this is the last). Shimmick Construction Company, Inc. was hired at the end of 2025 to complete the outfall replacement work at Sump 89 (City Agreement No. 2025-4635). Construction was put on hold during the rainy season so that the sump could be used in its expected capacity. Work has resumed and the schedule is extending longer than planned. Additional funds are needed to allow Peterson Brustad, Inc. to continue providing civil and structural engineering during construction, as well as environmental monitoring, compliance support, and regulatory permitting. Funding is also needed for 4LEAF to continue providing construction management and inspection services.
The AB339 determination for both contract amendments is that a 45-day REO notice is not required.
End
FinancialConsiderations
Financial Considerations: The original not-to-exceed amount of the Pump Outfall Replacement Project agreement with Peterson Brustad, Inc., (City Agreement No. 2020-1399) was $710,829. The net change by previous contract amendments was $1,280,596, that increased the agreement’s not-to-exceed amount to $1,991,425. In general, amendments were needed to include necessary modifications identified during civil and structural design development, as well as adjustments made during construction for the various outfall replacement projects covered under the original agreement. Additional amendments ensure that environmental monitoring and oversight timelines were aligned with the updated construction schedules. The proposed Contract Amendment No. 15, in the amount of $113,551, would increase the agreement not-to-exceed amount to $2,104,976.
The original not-to-exceed amount of the Construction Management Support Services for Sump 89 Outfall Replacement Project agreement with 4LEAF (City Agreement No. 2025-0642) was $244,581. The proposed Contract Amendment No. 1, in the amount of $117,798 would increase the agreement not-to-exceed amount to $362,379.
Sufficient funding exists in the Drainage Sump Replacement/Rehabilitation Program (W14130600, Fund 6021) to execute these contract amendments.
There are no General Funds planned or allocated for this project.
