Description/Analysis
IssueDetail
Issue Detail: The US Department of Justice (DOJ), Bureau of Justice Assistance (BJA), has allocated FY2025 Justice Assistance Grant (JAG) funding to eligible jurisdictions based on a federal formula using violent crime and population statistics. For FY 2025, Sacramento has been designated as a disparate jurisdiction. The combined JAG allocation for the City and County of Sacramento is $496,144. Under federal JAG rules for disparate jurisdictions, only one entity can serve as the fiscal agent and pass through the other entity’s share of the funding. The City’s agreed-upon allocation is $248,072.
As with all JAG programs, the funds must be used to support criminal justice activities as defined in 24 USC 10521(a)(1), including personnel, equipment, supplies, contractual services, training, technical assistance, and information systems related to crime prevention, control, and reduction.
The City’s proposed used of funds supports violent crime reduction strategies and improvements to law enforcement technology and operations. The Sacramento Police Department (SPD) intends to use the allocation to support SoundThinking (ShotSpotter) investments in north Sacramento, which aligns with the federal emphasis on crime and violence reduction.
Certifications and Assurances Requirements
Under 34 USC 10153, all JAG applicants must submit Certifications and Assurances by the Chief Executive of the Applicant Government. These include requirements that:
1) The application must be reviewed by the applicant’s governing body and made public for at least 30 days prior to certification.
2) An opportunity for public comment must be provided.
3) Federal funds must supplement (enhance), not supplant (replace), local funding.
4) The applicant agrees to maintain, and report required financial and programmatic data.
The original FY 2025 application deadline did not allow sufficient time for the SPD to present the Certifications and Assurances to Council at least 30 days before submission. Consistent with the JAG solicitation, the application will not be denied solely for this reason but access to the funds will be withheld until the Certifications and Assurances are executed following the required 30-day review period. Therefore, Council approval is necessary so the City Manager may complete the required certifications after the 30-day period.
