IssueDetail
Issue Detail: The Two Rivers Trail Project Phase II Project is intended to provide a link between the Jedediah Smith Trail on the north side of the American River Parkway, the Sacramento River Parkway, the Sacramento Northern Bikeway Trail, the future Ueda Parkway trails, and the 20th Street bike connection to the Central City.
Environmental review for the project was completed February 2020, and all permitting requirements to start construction were met. The project was awarded $3,333,000 from the 2017 State Active Transportation Program for construction of the Project. On December 8, 2022, the California Transportation Commission (CTC) approved the allocation of $3,333,000 for construction of the Project.
On December 12, 2023, the City Council awarded the construction contract to Martin Brothers Construction (2023-1637) for an amount not-to-exceed $2,676,769. Martin Brothers Construction started work on January 8, 2024. In December of 2024, contract working days were paused to allow for the United States Army Corp of Engineers (USACE) to complete its levee safety project which overlapped with the Two Rivers Trail project limits. Because of continuing delays on behalf of the USACE project, work on the Two Rivers trail project could not restart until March 2026.
Given the unforeseen delay, the contractor is entitled to construction price escalations, which will be reimbursed through contract change orders.

PolicyConsiderations
Policy Considerations: The Project is consistent with the Sacramento 2040 General Plan goals and key policies of promoting safety and enhancing livability, sustainability, and economic vitality as follows: the project promotes the development of an interconnected City (LUP-2.2), healthy transportation system options (M-1.3), increase bicycling and walking (M-1.11), improve walking connectivity (M-1.15), improve bicycling connectivity (M-1.17). The Project is consistent with the Mobility Element to create a well-connected transportation network through integration of recreation and community facilities with other public spaces. The Project is a near-term goal for the bikeway implementation plan.
The Sacramento City Code Section 3.04.020 limits the authority of the City Manager to execute contract amendments for up to 8% of the original contract price. The City Manager has previously executed change order requests increasing the total not-to-exceed amount of the contract. The amount of this change order will result in an increase of more than 8% of the original contract price so that Council approval is required since this change order exceeds the delegated authority of the City Manager.

EconomicImpacts
Economic Impacts: This new infrastructure is expected to create 0.09 total jobs (0.05 direct jobs and 0.04 jobs through indirect and induced actives) and create $14,342 in total economic output ($9,040 of direct output and another $5,302 of output through indirect and induced activities).
The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.

EnvironmentalConsiderations
Environmental Considerations:
California Environmental Quality Act (CEQA): The City approved an Environmental Impact Report for the Two Rivers Trail Phase II Project on February 4, 2020. The City Council certified an Environmental Impact Report (EIR) and adopted a Mitigation Monitoring Program for the Two Rivers Trail Phase II Project in compliance with CEQA on February 4, 2020 (Resolution No. 2020-0045). Following certification of the EIR, Staff filed a Notice of Determination with the Sacramento County Clerk on February 7, 2020. No further environmental review is required.
National Environment Policy Act (NEPA): The project is funded in part by federal funds. As a result, the project is also subject to the requirements of the National Environmental Policy Act. The California Department of Transportation (Caltrans) is the delegated lead agency for NEPA documentation. On August 29, 2022, Caltrans approved a Categorical Exclusion for the Project pursuant to the requirements of NEPA.

Sustainability: This Project is consistent with the City’s General Plan Climate Action Plan policies and programs to support active transportation connections.

Commission/Committee Action: The Project was presented at the Active Transportation Commission on January 17, 2019, and April 21, 2022. Recommendations, including concerns about overall paved width of the trail and the trail connection at Glenn Hall Park, were taken under advisement in the final design.

Rationale for Recommendation: Unforeseen construction delays beyond the City or contractor's control have led to extra costs. These costs include price escalations, mobilization, and minor design modifications to allow for the new improvements constructed by USACE.
Staff has concluded that Change Order No. 6 is a reasonable cost and the work is necessary to complete the construction project as intended. Approval by the City Council is required to authorize the City Manager to execute Changer Order No. 6. Staff recommends the City Council authorize the City Manager to approve Change Order No. 6 with Martin Brothers Construction.
