Description/Analysis
IssueDetail
Issue Detail:
The City of Sacramento (City) relies on SCS Engineers (SCS) for professional engineering services needed to maintain compliance with state and local landfill regulations. Recycling and Solid Waste (RSW) staff is requesting approval of Supplemental No. 4 to Agreement 2022-0986, increasing the not-to-exceed amount by $136,840. This increase will fund additional consulting services from licensed engineers to support landfill closure activities, ongoing monitoring, and required regulatory reporting.
The City’s landfill operations are regulated by multiple agencies, including the California Department of Resources Recycling and Recovery (CalRecycle), the Central Valley Regional Water Quality Control Board (Water Board), and the California Air Resources Board (CARB). Compliance with these regulations is enforced locally by the Sacramento County Environmental Management Department’s Local Enforcement Agency (LEA) and the Sacramento Metropolitan Air Quality Management District (SMAQMD). The additional engineering support services are necessary to meet these regulatory and enforcement requirements.

RationaleforRecommendation
Rationale for Recommendation: Professional engineering services from SCS Engineers are essential for the City to meet its ongoing post-closure regulatory obligations at multiple closed landfill sites. In recent years, SCS has assisted the City in responding to several outstanding compliance issues, while regulatory agencies have continued to expand monitoring, reporting, emissions, and documentation requirements. As a result, a substantial portion of the agreement’s budget has been used to address non-compliance issues and to meet new regulatory mandates, leaving insufficient funding for required ongoing work.
To continue performing these obligations, RSW staff recommends that City Council approve Supplemental Agreement No. 4 with SCS Engineers. The supplemental will update the following existing tasks:
• 401: Prepare Annual CalRecycle Inflation Factor
• 402: AB32 Greenhouse Gas Reporting
• 404: Flare Source Testing at 28th Street Landfill
• 409: Ongoing Support and Consultation for Landfill Sites
• 414: Greenhouse Gas Monitoring Reports
• 415: AB2588 Toxic Emission Inventory/Reporting
• 432: 28th Street Landfill Closure and Postclosure Management Plan
• 434: S-21 Compliance Issue
and establish the following new tasks:
• 437: MKV-3S Compliance Issue
• 438: Five-Yearly Iso-Settlement Survey of City Landfills
End
FinancialConsiderations
Financial Considerations: Supplemental Agreement No. 4 to City Agreement No. 2022-0986 will increase the not-to-exceed amount of $490,199 by $136,840 for a revised not-to-exceed total of $627,039. Sufficient funding exists in the Landfill Site Closure Project (Solid Waste Fund 6007) and 28th St Landfill Regulatory Project (Solid Waste Fund 6007 and General Fund 1001) as follows:

LocalBusinessEnterprise
Local Business Enterprise (LBE): SCS Engineers is not an LBE. This agreement was awarded under RFQ EV00000031 for On-Call Environmental Services, which was a competitive procurement conducted by the City’s Economic Development Department in 2019. This RFQ required consultants to submit their Local Business Enterprise certification status. LBE firms were given 5 additional points on the evaluation criteria worksheet.
