Additional Description/Analysis

IssueDetail

Issue Detail: The City of Sacramento settled the Barden et. al. v. City of Sacramento lawsuit on January 1, 2004. A primary provision of the settlement agreement was the “Annual Obligation” under which the City must expend an amount equal to twenty percent (20%) of its annual “Transportation Funds” (defined as eligible Measure A and Gas Tax funds) on removing or ameliorating obstacles in the pedestrian rights-of-way.

Under the terms of the settlement agreement the City agreed to submit to Class Counsel a Prospective Plan each year specifying how the City is proposing to spend the Annual Obligation during the upcoming year.  In compliance with the settlement agreement, staff has prepared the FY 2023/24 Prospective Plan. City Council must approve the Prospective Plan prior to its submittal to the Class Counsel. There was a delay in bringing this year’s Prospective Plan to the DAC due to staff changes and scheduling challenges. Staff has begun work on next year’s Prospective Plan to ensure that it is presented at the appropriate time.

In a look forward to the FY 2024/25 Prospective Plan, it is anticipated that the following projects may complete construction of accessibility improvements in the next fiscal year:

•                     Two Rivers Trail Phase 2 - multi-use trail

•                     Broadway Vision Zero - curb ramps, crosswalks, and signalized crossing

•                     HSIP-9 Lampasas Avenue at Rio Linda Boulevard Intersection Safety - sidewalk, curb ramps, crosswalks, and flashing beacons

•                     HSIP-9 Valley Hi Drive/La Mancha Way Safety Improvements - curb ramps, crosswalks, and signalized crossing

•                     Franklin Boulevard Complete Street Phases 1 and 2 - sidewalk, curb ramps, and crosswalks

•                     HSIP-10 Pedestrian Crossing Enhancements - curb ramp, truncated domes, and flashing beacons

The FY 2024/25 Prospective Plan is expected to be finalized in early Fall 2024.

FinancialConsiderations

Financial Considerations: The City’s estimated FY 2023/24 Annual Obligation is approximately $6,645,000. The FY 2023/24 Prospective Plan (Exhibit A) proposes to expend $13,584,000 on several program areas. Staff expects that every year there will be either an overage or shortage carried forward from the prior year.
