Description/Analysis

IssueDetail

Issue Detail: Staff recommends Council suspend competitive bidding in the best interests of the City and authorize an RFQ process to select contractors that will be invited to submit a bid for the North 5th Street Parallel Storm Trunk Main Project. Contractor selection will be by lowest responsible bid.  Use of the alternative procurement process will allow the City to select the most qualified contractor based on experience and resources needed to complete the project within an accelerated construction schedule to ensure the project’s Green Means Go Program Grant funding is expended in compliance with the grant agreement terms.

PolicyConsiderations

Policy Considerations: City Code Section 3.56.230(E) allows City Council to suspend competitive bidding or authorize an alternative method of procurement for a public project upon a two-thirds vote, if City Council determines that it is in the best interest of the City to do so. City staff believe that it is in the City’s best interest and that inserting an RFQ process will provide the best value to City utility ratepayers.

City staff propose the use of an alternative competitive procurement process for the contractor selection for the North 5th Street Parallel Storm Trunk Main Project. The City’s standard competitive bidding process is based on price alone, provided the contractor meets the minimum qualifications specified to perform the work. An RFQ process will allow the city to select qualified contractors who can perform the project scope on budget and on schedule. These contractors will be invited to submit bids on the project. The contractor with the lowest responsible bid will be selected. City Council approval is required for agreements of $250,000 or more per City Code 3.56.090 so staff will return to Council seeking approval to award a contract and authorize the City Manager or designee to execute a construction contract with the lowest responsible bidder.

EnvironmentalConsiderations

Environmental Considerations: This report concerns administrative activities and governmental fiscal activities that do not constitute a “project” as defined by California Environmental Quality Act (CEQA) Guidelines Sections 15378(b) and are not subject to the provisions of CEQA [CEQA Guidelines Section 15060(c)(3)].

End

Sustainability

Sustainability: The proposed project is consistent with the 2040 General Plan under policy PFS 3.1 as it continues the provision of reliable stormwater drainage service, and PFS-3.10 as it fosters the orderly and efficient expansion of facilities and infrastructure to adequately meet projected needs, comply with current and future regulations, and maintain public health, safety and welfare.

RationaleforRecommendation

Rationale for Recommendation: The City received a Green Means Go grant from the Sacramento Area Council of Governments (SACOG) (Contract # 230059) to construct capacity improvements for the Sump 111 drainage pump station.  Detailed studies and modeling showed that to achieve the desired increase in pumping capacity at the pump station, stormwater runoff needed to get to the station quicker.  The North 5th Street Parallel Storm Trunk Main Project has the capability to double the flow to the pump station. The pipeline project constructs approximately 1,640 feet of a combination of 72-inch and 84-inch diameter storm pipe. To expend the grant funding within the funding agreement timeline, the department has pivoted to bidding the pipeline project. SACOG supports this action. At the March 19, 2026, meeting, the SACOG Board approved Amendment No. 3 to the City’s grant agreement that modified the scope to include the parallel trunk main project.  The pipeline project and the pump station improvements will fully mitigate increased flooding associated with full build out in the Basin 111 drainage shed. These improvements will allow many higher density projects to proceed without costly onsite drainage mitigation, leading to more housing and lower costs for housing developments.

Suspending competitive bidding and using a Request for Qualifications process will allow contractors to demonstrate the knowledge, skill, and resources needed to successfully build this project in compliance with the grant agreement terms and schedule. This process enables the City to solicit bids from a qualified pool of contractors with the experience to successfully bid and construct the North 5th Street Parallel Storm Trunk Main Project on schedule and within budget.

FinancialConsiderations

Financial Considerations: The recommendations in this report do not result in any financial impact to the City. Upon approval of this recommendation and following completion of the RFQ process and the bid advertisement, staff will submit a recommendation to City Council to authorize the City Manager to execute a construction contract with the lowest responsible bidder.

There are no General Funds planned or allocated for this project.
