Issue Detail: Assembly Bill 481 (AB 481 or the Bill), codified at Government Code sections 7070 through 7075, requires a law enforcement agency (LEA) to obtain approval from the applicable governing body, via adoption of a “military equipment” use policy (the Policy) by ordinance (the Ordinance), prior to the LEA funding, acquiring, or using military equipment. On August 12, 2025, City Council approved the Sacramento Police Department’s (SPD) 2025 Military Equipment Use Policy - General Order (GO) 410.06 to allow SPD to continue to use the vital equipment specified therein. SPD’s 2026 Military Equipment Use Policy-Draft has been published for review (Exhibit A).
Items deemed to be “military equipment” by AB 481 are used as a component of overall best practices for LEAs throughout the country. These tools have been tested in the field and are used by LEAs to enhance citizen and officer safety. Loss of these items would jeopardize the welfare of the community and peace officers within the SPD.
Pursuant to AB 481, items deemed to be “military equipment” include unmanned aerial or ground vehicles, armored vehicles, high mobility multipurpose wheeled vehicles, tracked armored vehicles, command and control vehicles, weaponized aircraft, vessels, or other vehicles, explosive breaching apparatuses, firearms of .50 caliber or greater, ammunition of .50 caliber or greater, specialized firearms or ammunition, firearms or launchers with explosive projectiles, flashbangs and chemical agents, long range acoustic devices, and projectile launching platforms and munitions.
SPD is committed to using the most up-to-date tools and equipment to safeguard the community of Sacramento. Although classified as “military equipment” under AB 481, many of the items requested for approval are in fact utilized by SPD, and other LEAs across the country, specifically in order to reduce risk to community members. These items provide peace officers with the ability to safely resolve volatile situations that otherwise might rise to the level of a lethal force encounter. To that end, the items in this report, and the accompanying Military Equipment Use Policy (MEU), provide SPD’s peace officers with vital tools that facilitate compliance with SPD’s use of force policy.
SPD is required by law to annually obtain City Council approval of a renewed ordinance for the funding, acquisition, or use of military equipment, and to present a Military Equipment Use Annual Report (Exhibit B).
SPD’s internal inspections and audits identified five (5) items of equipment, the accounting of which requires updated reporting from 2025.
1. PepperBall VKS Carbine

The 2025 audit reported that SPD was in possession of 85 items of the above. One (1) additional item (purchased prior to Assembly Bill 481) was located resulting in an updated department inventory. The 2026 audit determined SPD to be in possession of 86 of the above item.
2. Remington Model 870, 12 Gauge Shotgun

The 2025 audit reported that SPD was in possession of 552 items of the above. Two (2) of the above items were lost during the same event during patrol operations (Event #26-12934). Four (4) additional items were located and determined to have been converted from lethal to less lethal systems resulting in an updated department inventory. The 2026 audit determined SPD to be in possession of 556 of the above.
New Military Equipment Procurements
The updated MEU identifies items which SPD may procure. These items are possible procurements only; SPD ultimately may not procure this equipment. The proposed procurements are either part of the existing police budget or would be funded by grants for which SPD would apply to replace, repair, or obtain equipment. Total cost does not include tax or shipping and are based on cost at the time of this report.

MEU Community Meeting Feedback
On July 29th, 2026, the Sacramento Police Department and the Sacramento Community Police Review Commission hosted a community meeting regarding the Annual Military Equipment Use Report and Policy, in compliance with Government Code 7072(b). The following topics were discussed during the community meeting with community request for follow-up from SPD.
1. Outside Agency Assistance
a. The community requested more information on what incidents labeled “outside agency assistance” included federal agencies. The following incident numbers involved SPD assisting. Further information about each incident can be seen below and located in appendix B of the report;
i. 25-142331 (US Marshalls)
1. A suspect who was wanted for the rape and sodomy of a 13-year-old girl was located by the US Marshalls in the City of Sacramento. The US Marshalls authored a search warrant and SPD SWAT team responded and independently served the high-risk warrant. The suspect was ultimately located inside the residence deceased from what appeared to be a self-inflicted gunshot wound. Once the scene was secure, SPD turned over the scene to the US Marshalls. Only SPD used the equipment.
ii. 25-288486 (FBI)
1. A SPD Detective who was working with the FBI authored a search warrant. The warrant was related to an investigation that involved firearms, drug sells, and potential gang activity. SPD SWAT responded to a location in the city and independently served the high-risk warrant. A suspect was located and arrested for two outstanding warrants. Once the scene was secure, SPD turned over the scene. Only SPD used the equipment.
iii. 25-296545 (US Marshalls)
1. A Bay Area Jail facility mistakenly released a murder suspect from custody. The US Marshalls received information that the suspect may have been at a location in the city. The US Marshalls authored a search warrant and SPD SWAT team responded and independently served the high-risk warrant. The suspect was not located and once the scene was secure, SPD turned over the scene to the US Marshalls. Only SPD used the equipment.
b. Next year’s MEU report will include information regarding whether any of the outside agency assistance call initiation type involved a federal agency.
2. Personnel and Training Costs
a. Community members requested more information regarding the annual costs, particularly the personnel and training costs.
i. ‘Annual Costs’ are defined in the report as the approximate and applicable total of acquisition, personnel, training, transportation, maintenance, storage, upgrade, or other ongoing costs. ‘Personnel and training costs are defined in the report as the total of an employee’s salary incurred during military equipment usage and training. This includes, but is not limited to, course tuition and materials, travel and lodging expenses, certification and licensing, and portions of an employee’s salary that is calculated utilizing the average of all employee pay scales.
ii. ‘Maintenance costs’ is defined in the report as the cost of routine preventative maintenance, replacement parts, software, licensing, contract fees, and outside vendor services (e.g., labor, parts, materials). Maintenance completed by employees includes employee salary costs calculated utilizing the average of employee’s pay scales. Each equipment category’s annual costs are listed in the report, which are made up of the personnel and training costs and the maintenance costs. The community expressed a desire for more detailed information regarding each annual cost. Due to the lengthy amount of data this would entail, and the direction given by the council to make this digestible document, the present work plan is to preserve the existing layout for next year.
3. Uncrewed Vehicle System Video Policy
a. The community expressed concerns regarding Uncrewed Vehicle System video being shared with other law enforcement agencies and concern with community privacy.
i. General Order 525.09 Uncrewed Vehicle Systems states “any audio, video, or images captured during training flights shall be retained for at least two years. Any training video that inadvertently captures images or evidence related to a crime or other significant event shall be retained in accordance with the City of Sacramento retention schedule. Video recordings shall be retained in accordance with the crime classification listing in the City of Sacramento retention schedule. Digital evidence captured by UVS cameras shall be treated as official records and handled in accordance with existing department orders. Any attempt to erase, alter, or tamper with UVS camera recordings, except as authorized by law or department policy, shall be a violation of department policy. All recordings made using UVS cameras are the property of the SPD and shall not be released or disseminated without the express written consent of the chief of police or designee, or unless otherwise required by law.”
ii. In accordance with the General Order 525.09 Uncrewed Vehicle Systems “the use of a UVS involves privacy considerations. SPD Employees shall adhere to FAA altitude regulations. They shall not intentionally record or transmit images of any location where a person has a reasonable expectation of privacy, absent a warrant, court order, or an appropriate exigent circumstance.”

RationaleforRecommendation
Rationale for Recommendation: There is significant interest in ensuring that law enforcement continues to have access to equipment that will provide peace officers as many options as possible to safeguard lives, ensure safety, and protect civil liberties. The use of the tools identified below is vital to SPD’s mission and will continue to be strictly regulated through internal processes and oversight.
SPD’s current GO 410.06, outlining all approved military equipment, was adopted by ordinance on August 12, 2025. GO 410.06, which constitutes SPD’s Military Equipment Use Policy, outlines each item identified in Government Code section 7070 currently approved for use. GO 410.06 includes use considerations, equipment reporting considerations, manufacturer description, purpose, authorized use, training, lifespan, and cost of each item (Exhibit A). SPD is requesting that the City Council approve the updated version of the Policy, detailing items previously approved and adding those mentioned above.
GO 410.06 safeguards the public’s welfare, safety, civil rights, and civil liberties. GO 410.06 ensures that there are transparency, oversight, and accountability measures in place. For instance, GO 410.06 provides that SPD’s Inspection and Standards Team (IST) will ensure compliance with the policy. Additionally, SPD will conduct an annual audit of military equipment. Violations of GO 410.06 will be corrected when discovered. Members of the public are provided direction in the policy on how to register complaints for violations. All equipment involved in a use of force incident will be investigated, as is already required by existing SPD policy. Approval of this ordinance and policy will approve future, specified acquisitions of equipment listed in GO 410.06 (Exhibit A).
