Description/Analysis

IssueDetail

Issue Detail: The purpose of the proposed Sacramento Ethics Commission Procedures (Procedures) is to establish and maintain fair and transparent standards for investigating and determining matters before the Sacramento Ethics Commission (Commission) and to ensure the fair, just, and timely resolution of complaints presented to the Commission. The Current Procedures document was adopted by the Commission on September 26, 2022. It is best practice to periodically review the Procedures.

Policy Considerations: Chapter 2.112 of the Sacramento City Code established the Sacramento Ethics Commission and specifies the Commission’s powers and duties (in section 2.112.030). In furtherance of those powers and duties, the Commission is to adopt (1) regulations and procedures for the conduct of its business, (2) regulations and procedures for investigations and hearings to be conducted by the Commission, and (3) a policy setting forth its standards for imposing penalties and exercising enforcement discretion.

Economic Impacts: Not applicable.

Environmental Considerations:

California Environmental Quality Act (CEQA): This action is not a project subject to CEQA because it involves only general policy and procedure making and does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  (CEQA Guidelines, §§ 15002(d), 15378(b)(2), 15061(b)(3).)

Sustainability: Not applicable.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: It is recommended that the Commission review the procedures and make updates as appropriate to clarify any section of the Procedures.

Financial Considerations: Not applicable.

Local Business Enterprise (LBE): Not applicable.
