Description/Analysis

IssueDetail

Issue Detail: The California Public Employees’ Retirement System (CalPERS) has notified the City of Sacramento that certain historical salary schedules, used for reporting compensation to CalPERS, are not in compliance with Government Code and regulatory requirements. The affected schedules did not contain explicit effective dates for each pay range, as required by Government Code § 20636 and California Code of Regulations, Title 2, § 570.5, and did not consistently identify the applicable unit of measure for each rate of pay, such as hourly, daily, or annual rates.

CalPERS has directed the City to retroactively correct and re-adopt all affected salary schedules for the prior five-year retention period, as mandated by California Code of Regulations (CCR), § 570.5. The corrections ensure that all rates of pay are properly authorized by the City Council, publicly available, and certified as duly adopted in open session, with each schedule clearly reflecting a revision date and the applicable unit of measure.

This action is administrative in nature and does not alter employee pay rates, benefits, or bargaining unit agreements. It updates historical records to reflect clear effective dates, revision dates, Council adoption, and clearly identified units of measure, satisfying CalPERS’ compliance requirements.

The Department of Human Resources has reviewed 41 salary schedules adopted between 2020 and 2025, corrected formatting and date references, added revision dates and units of measure where required, and compiled all schedules for formal re-adoption through this Council action.

An informational guide (Attachment 44) is included that outlines CalPERS guidance on the use of the updated salary schedules when requesting a compensation compliance re-evaluation for retired or retiring employees.

PolicyConsiderations

Policy Considerations: Government Code § 20636 and CCR Title 2 § 570.5 require that compensation reported to CalPERS be derived from publicly available pay schedules adopted by the City Council. Re-adoption of the corrected schedules ensures full compliance and safeguards the City’s ability to accurately report compensation for retirement purposes.

RationaleforRecommendation

Rationale for Recommendation: Re-adoption of corrected historical salary schedules is required to maintain compliance with CalPERS and Government Code standards. The inclusion of effective dates for each classification and the addition of revision dates and clearly identified units of measure for each rate of pay ensures transparency, proper documentation, and adherence to the “publicly available pay schedule” requirement. Approval of this report will allow the City to transmit certified schedules to CalPERS and resolve outstanding compliance findings.

FinancialConsiderations

Financial Considerations: None. All affected salary schedules reflect previously approved compensation rates and have no fiscal impact.
