Description/Analysis

IssueDetail

Issue Detail: The Department of Public Works, Facilities & Real Property Management Division currently contracts with professional consulting firms for a variety of professional services, including architecture, engineering, environmental and other professional services to supplement staff during peak workloads and provide additional expertise when required. On- call agreements are often established as “best management practices” to provide additional services to assist staff with delivering projects efficiently and effectively, on time and within budget parameters.

This action would authorize the Interim City Manager or designee to enter into on-call agreements with the firms that have been listed in Exhibit A for engineering and other construction related services. It would also create a pre-qualified list of consultants that city staff could reach out to and solicit proposals for job specific work and when selected enter into a contract for the project.

PolicyConsiderations

Policy Considerations: The recommendation in this report is in accordance with City Code Chapter 3.56 regarding contracts for professional services, which requires City Council approval of contracts of $250,000 or more.

EnvironmentalConsiderations

Environmental Considerations: California Environmental Quality Act (CEQA): Approval of the professional service contracts are not projects as defined by CEQA guidelines, Section 15378. The recommended action involves no physical construction and has no potential to cause a significant impact to the environment, as the projects for which these services may be needed have not yet been specifically identified. The construction projects for which the listed consultants’ services are ultimately used will be separately analyzed under CEQA prior to construction.

RationaleforRecommendation

Rationale for Recommendation: On October 3, 2024, the Department of Public Works, Facilities and Real Property Management Division issued a Request for Qualifications (RFQ) for On-Call Professional Services in Engineering and Construction Related Tasks (Q24014541005). The purpose of this RFQ was to develop a list of qualified on-call consultants with expertise in specialized areas including Civil Engineering, Electrical Engineering (including voice/data), Energy Efficiency Services, Mechanical Engineering (plumbing, fire protection, HVAC), Structural Engineering, Surveying and Grant Research, Writing and Management Services. Selected firms would support facilities staff in executing projects through various delivery methods, including design-build, design-assist and standard bid / build. These projects may involve public buildings and facilities, public safety buildings, community centers, libraries, park facilities, pools, corporation yards, and related offsite improvements.

A total of 43 proposals were received for the On Call Professional Services - Engineering and Construction Related Tasks Category. A selection committee composed of subject matter experts from the Public Works Department and the Department of Youth, Parks & Community Enrichment evaluated and ranked proposals based off their qualifications to complete tasks under the scope of services and the evaluation criteria that was provided in the RFQ. The selection committee determined that the consultants listed in Exhibit A were the most qualified to provide the requested services and should be included on the On Call Consultant list for a five-year term. Each on-call agreement will be in an amount that is identified in Exhibit

FinancialConsiderations

Financial Considerations: When professional services are required, City staff will prepare a scope and issue a request for proposals to the pre-qualified consultants that is qualified to complete the task order. Once selected, and a cost schedule is agreed upon, a purchase order will be encumbered against a fully funded project. Professional service providers may have multiple service requests or purchase orders during a given fiscal year; however, the amount of the purchase order may not exceed the aggregate agreement amount identified in Exhibit A for the term of the agreement.

LocalBusinessEnterprise

Local Business Enterprise (LBE): The RFQ required consultants to submit their local business enterprise certification status. The LBE preference requirement was applied by providing local business firms with 5 additional points on the evaluation criteria worksheet; however, the LBE participation requirement for all firms was waived by the City Manager’s Office.  The certified LBE firms are identified in Exhibit A.
