Description/Analysis

IssueDetail

Issue Detail: SCS Engineers (SCS) provides professional engineering support services to ensure compliance with landfill regulations. The second Supplemental Agreement will extend the term of the agreement through September 27, 2027, and increase the budget by $163,599 for a new not-to-exceed amount of $368,699. These funds will be used to continue the engineering consulting services that SCS provides for landfill closure, monitoring, and reporting work. Both the Sacramento County Environment Management Department Local Enforcement Agency (County LEA) and the California Department of Resources Recycling and Recovery (CalRecycle) also require a certified engineer to develop, review, and sign these reports.

RationaleforRecommendation

Rationale for Recommendation: Certified engineering consultant services are necessary for the City to fulfill its ongoing regulatory obligations with its multiple closed landfill sites. Besides assisting the City with regulatory reporting, SCS is involved in addressing several outstanding requests for compliance related to the City’s closed landfills. As a result, a sizable portion of the agreement’s current budget is being used to respond to these compliance requests from regulatory agencies. RSW staff recommends Council approve Supplemental Agreement No. 2 with SCS to replenish the budget, establish a contingency amount for future regulatory concerns, and extend the agreement’s term for one additional year.

End

FinancialConsiderations

Financial Considerations: The second Supplemental Agreement will increase the not-to-exceed amount by $163,599 which accounts for extending the contract term by one additional year to September 27, 2027, reconciling the costs of several unexpected requests for compliance, and setting aside a contingency amount for future compliance measures at the City landfills. This increase sets the new not-to-exceed amount to $368,699. There is sufficient funding available to execute this Supplemental Agreement in the Landfill Site Closure Project (Y14000100), the 28th St Landfill Regulatory Project (Y15000100), and the Commercial Waste Compliance MYOP (I15220000).

LocalBusinessEnterprise

Local Business Enterprise (LBE): SCS Engineers is not an LBE. This agreement was awarded under RFQ EV00000031 for On-Call Environmental Services, which was a competitive procurement conducted by the City’s Economic Development Department in 2019. This RFQ required consultants to submit their Local Business Enterprise certification status. LBE firms were given 5 additional points on the evaluation criteria worksheet.
