Description/Analysis
IssueDetail
Issue Detail: The Department of Utilities (DOU) administers a program that assists residential single-family water service customers in disadvantaged communities with leak detection and repairs. The existing agreement supporting this program requires a one-year extension to allow sufficient time to complete a new solicitation and execute a contract for these services.
City staff limits its repairs to the city side of the water meter and does not do repairs for homeowners. Under the City’s direction, the plumbing contractor performs leak repairs identified through leak notification letters and Water Conservation investigations, after customers apply for assistance from the Leak Free Sacramento program. The City contracted plumber warranties their work for a year, so the liability rests with the plumber and not the City.

PolicyConsiderations
Policy Considerations: City Council approval is required for all contracts involving an expenditure s of $250,000 or more per City Code 3.56.090. Additionally, the City Manager’s authority to execute contract amendments is reset pursuant to City Code 3.04.020.

EnvironmentalConsiderations
Environmental Considerations: On October 10, 2023, it was determined that the agreement activity was not a “project” pursuant to Section 15378(b)(2) of the CEQA Guidelines. The proposed contract amendment for ongoing residential plumbing services is a continuing administrative and maintenance activity [CEQA Guidelines section 15378 (b)] and is not subject to CEQA [CEQA Guidelines Section 15060(c)(3)]. Resulting plumbing activities are exempt from CEQA pursuant to CEQA Guidelines Section 15301 (Existing Facilities), which consists of the operation, repair, maintenance, and minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features.

Sustainability
Sustainability: The proposed contract amendment is consistent with the 2040 General Plan PFS-3.1 as it is related to public facilities and safety, including providing reliable water, wastewater, and stormwater drainage service to the City of Sacramento.

RationaleforRecommendation
Rationale for Recommendation: On June 16, 2023, DOU issued Request for Proposals (RFP) P23141381512 for residential plumbing services in support of the Leak Free Sacramento Program. Through PlanetBids, 154 suppliers were notified, 21 suppliers self-identified as prospective bidders, and fourteen proposals were received and opened on July 13, 2023. The DOU selection panel evaluated the proposals and determined Toby D. Kunz Plumbing to be the top-ranked firm to provide the services. City Council approved City contract 2023-1376 on October 10, 2023, for three years of services not to exceed $650,000.
Contract amendment No. 01 is proposed to modify service costs and extend services for one year through and including September 5, 2027, to provide sufficient time for DOU staff to review operational needs and process a solicitation for future Leak Free Sacramento Program services.

FinancialConsiderations
Financial Considerations: Sufficient funding for the additional year of the agreement in an amount not to exceed $650,000, remains available in the Water Conservation Program Multi-Year Operating Program (MYOP) (I14120400, Fund 6005), which was funded by a water sales transfer authorized by City Council that was to specifically fund water efficiency within the City’s low-income communities. Purchase orders encumbering funds under this agreement will not be created until needs and funding are identified in the applicable budget (operating, capital, multi-operating, or grants) in the applicable fiscal year.
There are no General Funds allocated or planned for this project.
End
LocalBusinessEnterprise
Local Business Enterprise (LBE): Toby D. Kunz Plumbing is not an LBE. The minimum LBE participation requirement was previously waived by the Director of Utilities as staff determined the waiver was in the City’s best interest due to the lack of competitive local proposals.
