Issue Detail: On February 4, 2025, the Sacramento City Council authorized acceptance of the Fiscal Year (FY) 2024 Urban Area Security Initiative Grant (Resolution 2025-0024) from the California Office of Emergency Services (CalOES). The UASI grant is a component of the federal Homeland Security Grant Program (Federal Assistance Listing #97.067), authorized in Section 2006 of the Homeland Security Act of 2002 (Act).

 

The purpose of the UASI program is to support high-threat, high-density federally recognized urban areas to build, sustain, and deliver the capabilities to prevent, prepare for, protect against, and respond to threats, hazards, and acts of terrorism.

 

CalOES, as authorized by federal grant guidance, administers federal UASI funding at the state level.  As a fiscal agent for the grant program, the City is responsible for managing a $2,820,672 local allocation and distributing funds among regional partners (subrecipients) and suppliers (procurement). The Sacramento Urban Area consists of Sacramento, El Dorado, Placer, and Yolo counties.

 

As a condition of the grant award, 30% of the funding received must be allocated to support law enforcement terrorism-prevention-oriented activities. To meet this requirement, the Sacramento Police Department (SPD) seeks City Council authorization to pass through federal grant funds to the Sacramento County Sheriff’s Office for staffing of the Central California Intelligence Center (CCIC) - Regional Threat Assessment Center (CCIC) to carry out the provision of law enforcement services.

PolicyConsiderations

Policy Considerations: The recommendations contained in this report are consistent with Sacramento City Code 3.56.090, which requires City Council approval to award a contract of $250,000 or more. This item is not subject to competitive bidding requirements, and it does not meet the definition of a procurement action as defined at Title 2, Part 200, Section 330 of the Code of Federal Regulations (2 CFR 200.330).

 

In addition, certain requirements of City Code are not applicable for the following reasons:

 

1)                     SCC Chapter 3.54 - County of Sacramento is a public entity (3.54.030(B)

2)                     SCC Chapter 3.58 - the County of Sacramento is subject to state and/or federal prevailing-wage laws (3.58.020(B)(5))

3)                     SCC Chapter 3.60 - the scope of work does not include maintenance or repair of public buildings or works (3.60.010)

4)                     SCC Chapter 3.62 - the County of Sacramento is a unit of local government (3.62.020(C))

RationaleforRecommendation

Rationale for Recommendation: Section 2006 of the Homeland Security Act of 2002, as amended (6 USC § 607), requires that 30 percent of funding awarded under this program be used for Law Enforcement Terrorism Prevention Activities (LETPA). The services described in this agreement align with the allowable activities as described in 6 USC §607(a)(2)(A), (G), and (H). Specifically, 6 USC §607(a)(2)(G) includes as allowable activities, “establishing, enhancing, and staffing with appropriately qualified personnel state, local, and regional fusion centers.” As defined in 6 USC 124(j), a “fusion center” is “a collaborative effort of two or more federal, state, local or tribal government agencies that combines resources, expertise, or information with the goal of maximizing the ability of such agencies to detect, prevent, investigate, apprehend, and respond to criminal or terrorist activity.”

 

The fusion center for the Sacramento region is the CCIC, which serves as a clearinghouse for intelligence analysis and information sharing for crimes and all-hazard threats for the Eastern District of California. The CCIC is designed to be an analytically driven fusion center that supports law enforcement information needs with an emphasis on terrorism intelligence. The Terrorism Liaison Officer Program, FBI - InfraGard Program, and the FBI’s Joint Terrorism Task Force missions are also supported by the CCIC.

 

The subaward will fund the following positions at the CCIC:

 

                     Cyber and Intelligence Analysts

                     Critical Infrastructure Protection Program Managers

                     UASI Support Technician

                     Deputy Director

 

These CCIC positions, as described in Exhibit C of the attached agreement, support the following CalOES-approved projects within the Sacramento region:

 

                     Cybersecurity Network Vulnerability Testing

                     Intelligence and Information Sharing

                     Combatting Domestic Violent Extremism

                     Enhancing Election Security

 

These approved projects are consistent with federal department of Homeland security grant guidance addressing national security priorities. These priorities include: 1) Enhancing Cybersecurity; 2) Enhancing the Protection of Soft Targets/Crowded Places; 3) Enhancing Information and Intelligence Sharing and Analysis; 4) Combatting Domestic Violent Extremism; and 5) Enhancing Election Security. The CCIC organization staffing costs detailed in the Exhibit C Subrecipient Workbook satisfy the mandatory 30 percent Law Enforcement Terrorism Prevention Activities grant program requirement.
