Recommendation
Recommendation: Conduct a public hearing and upon conclusion: 1) adopt Ordinances amending various sections of chapter 5.138 and 9.12 Article II of the City of Sacramento City Code relating to tobacco retailers, as required by Sacramento City Charter 32 (C) submitted to the City Council for adoption on July 21, 2026; and 2) in lieu of publishing the ordinance title, publish the ordinance in full in the official newspaper of the City within ten days after adoption by the council, consistent with City Charter section 32(d).

Issue Detail: On April 16, 2019, City Council adopted amendments to Chapter 5.138 of the City Code relating to tobacco retailers to strengthen regulations. The amendments, among many things, included a prohibition of flavored tobacco products and a distance requirement between tobacco retailers.
