Description/Analysis
IssueDetail
Issue Detail: Established under the authority of the Parking and Business Improvement Area Law of 1989 and City Code Chapters 3.96 through 3.112, the purpose of the BIA districts is to provide enhanced economic revitalization and physical maintenance services to specific business districts. The funding of these services and activities are provided by an assessment imposed on the individual businesses. The BIAs located in the City and included in this report are the Del Paso Boulevard BIA, the Downtown Plaza BIA, the Franklin Boulevard BIA, the Old Sacramento BIA, the Stockton Boulevard BIA, and the Sutter BIA.
Annually, each BIA is required to submit an Annual Report (Report) for Council approval as a prerequisite to Council levying the annual assessment. The BIA Advisory Boards, which are appointed by Council and generally made up of business owners within the BIA districts, have prepared the required Reports for FY2026/27, detailing the proposed assessments and expenditure budgets. The BIA Annual Amounts Schedule, included as Attachment 3 to this report, provides a summary of the proposed FY2026/27 assessments for each BIA. In addition, the Report for each BIA is attached as Exhibit A to the BIA’s respective resolution.
Staff recommends Council adoption of the six resolutions that will approve the associated Report, set the time and place for the public hearing on the proposed assessment, and authorize the City Clerk to publish the resolutions in the City’s official newspaper pursuant to Streets and Highways Code section 36534(b).

Policy Considerations: The recommended actions will establish the budget for assessment expenditures, ensuring that funds collected for each BIA via business-based assessments are used for the intended purpose, which is to promote the economic revitalization and physical maintenance of the BIAs in an effort to create jobs, attract new businesses, and prevent erosion of existing businesses.

Environmental Considerations: Under the California Environmental Quality Act Guidelines, the continuing administrative activities of BIAs and creation of government funding mechanisms or other government fiscal activities which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment do not constitute a project and are therefore exempt from review [14 Cal. Code Regs. § 15378(b)(2), (b)(4)].

FinancialConsiderations
Financial Considerations: The proposed expenditures are supported by charges assessed against each business within the BIA. Pursuant to the applicable City Code section for each BIA describing the charges imposed, an automatic annual increase to BIA charges is authorized to account for inflation (except within the Sutter BIA). The automatic increase is based on the most current Consumer Price Index (CPI) - San Francisco All Urban Consumers data. The percentage increase in the CPI between February 2025 and February 2026 was 2.5%. Accordingly, charges for Del Paso Boulevard, Downtown Plaza, Franklin Boulevard, Old Sacramento, and Stockton Boulevard BIAs will increase by 2.5% effective July 1, 2026, as shown in the attached BIA Annual Amounts Schedule. The Sutter BIA charges do not increase annually because City Code chapter 3.106 does not provide an annual increase for inflation. The Del Paso Boulevard, Franklin Boulevard, Stockton Boulevard, and Old Sacramento BIA charges cannot exceed more than 10% annually while the Downtown Plaza BIA charges cannot exceed more than 5% annually.
The City collects the BIA charges at the time the Business Operations Tax is paid. The charges are then forwarded to the respective BIA Advisory Board authorized by Council to conduct activities and services for the BIA. The proposed BIA expenditures are fully supported by charges assessed against each business, however collection costs are supported by the City.
