Recommendation: Adopt a Resolution: 1) rescinding Resolution 2026-0021 in order to amend section 1(D); 2) authorizing the City Manager or designee to apply for the

Central Valley Flood Protection Board (Board), Sacramento and San Joaquin Drainage District (SSJDD) Abatement Pilot Program Reimbursement Grant; 3) if awarded, authorize the City Manager or designee to sign the agreement, prepare the necessary data, and execute all reporting, payment requests and documentation of compliance applicable to the grant and completion of the program; 4) if awarded, authorize the City Manager or designee to establish the Fiscal Year (FY) 2025/26 Department of Utilities (DOU) Operating Grant Program (G14260100); and 5) if awarded, establish the revenue and expenditure budgets in the FY2025/26 DOU Operating Grants Program (G14260100, Fund 6211) in an amount not to exceed $340,000.

Description/Analysis

Issue Detail: On February 3, 2026, City Council adopted Resolution No. 2026-0021 for the City to apply for the Central Valley Flood Protection Board, Sacramento and San Joaquin Drainage District Abatement Pilot Program Reimbursement Grant in an amount not to exceed $340,000.    

 

However, the resolution approved by City Council incorrectly referenced the project fund 6205 and incorrectly stated, adjusting FY2025/26 DOU Operating Grant Program (G14260100, 6205) instead of establishing FY2025/26 DOU Operating Grant Program (G14260100, 6211). 

 

Per direction from the City Clerk’s Office, an administrative correction is necessary to amend the incorrect project fund number and verbiage, and the correction must be approved by the City Council.

Policy Considerations: These recommendations are consistent with Council Resolution 2025-0162, which requires Council authorization to establish operating grants of more than $250,000, and when such action is required by a grantor.

Environmental Considerations:

California Environmental Quality Act (CEQA): It has been determined that the proposed activity is not a project pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15378(b). The fiscal management of the DOU’s Capital Improvement Project is an ongoing administrative fiscal activity and is not subject to CEQA pursuant to CEQA Guidelines Section 15060(c)(3). Future activities that may result from receiving the grant would be exempt pursuant to CEQA Guidelines Section 15307 - Actions by Regulatory Agencies for the Protection of Natural Resources and Section 15308 - Actions by Regulatory Agencies for the Protection of the Environment.

Sustainability: The project is consistent with the City's Sustainability Master Plan goal by enabling DOU to continue to improve flood protection. These projects help to minimize the City’s vulnerability in areas where flood maintenance is severely impeded by illegal dumping, debris, and hazardous waste as a result of human activity on levees and in waterways.

...RationaleforRecommendation

Rationale for Recommendation: The Board, as the owner of more than 9,441 parcels (over approximately 27,000 acres), many located along rivers and streams, has an ongoing responsibility to ensure proper maintenance on property under its jurisdiction. Most of the costs associated with SSJDD property maintenance and preservation needs can be scheduled based on periodic inspections and assessments. However, there is a portion of the unsheltered population who live in encampments adjacent to rivers, levees, and waterways in the City, resulting in unplanned maintenance and abatement. This funding will help the City with the unplanned maintenance and abatement of existing hazardous conditions in a continued effort to protect life, property, infrastructure, and wildlife habitat in and around the City’s waterways.

 

City Council approval is needed to correct the budgetary language within the adopted resolution.

Financial Considerations: If awarded, the City would receive up to $340,000. This grant opportunity does not have a match requirement. If awarded, staff recommend establishing the FY2025/26 DOU Operating Grant Program (G14260100) and establishing the revenue and expenditure budgets in the FY2025/26 DOU Operating Grant Program (G14260100, Fund 6211) for a not-to-exceed amount of $340,000.
