Issue Detail: The City’s Convention Center Complex is undergoing an extensive expansion and renovation project which will result in the fabrication, construction, installation, or purchase of several public art projects that are to be publicly displayed and enjoyed by the public and attendees at Sacramento Convention Center events.
The Sacramento Metropolitan Arts Commission is charged with providing for the nature, selection, and placement of artworks subject to final approval by Council. As set forth in Section 2.84.130 of the City Code, the Sacramento Metropolitan Arts Commission (SMAC) recommends selection of artwork for the Art in Public Places (APP) program. This report recommends that City Council authorize the execution of an agreement with De La Torre Brothers, Inc., which is the corporation owned by the artists James and Einar De La Torre (“Artist Team”), in an amount not to exceed $220,000 for the final design and budget for the sculptural artwork,which is to be placed on the corner of J and 13th Streets next to the Sacramento Convention Center.
Once the final design and budget has been completed, the Artist Team may move forward with the fabrication, construction, and installation of the artwork at the corner of J and 13th Streets next to the Sacramento Convention Center, pending Council approval. The City will also purchase the artwork from the Artist Team.
Policy Considerations: SMAC’s selection of the above-mentioned artwork for the Sacramento Convention Center satisfies the APP program policies and procedure and the program goal of site-specific public art.
Economic Impacts: None
Environmental Considerations: Under the California Environmental Quality Act (CEQA), continuing administrative activities, such as what is recommended in this report, do not constitute a “project” [CEQA Guidelines section 15378(b)(2)].

Commission/Committee Action: In accordance with City Code section 2.84.080(E), SMAC has the authority to make recommendations to the City on all artworks to be acquired by the City either by purchase or gift.
On October 8, 2018, SMAC unanimously approved the design concept of the artwork “Heart of California.” SMAC recommends that the City execute an agreement with the Artist Team for the final design and budget of the artwork as the first step for eventual placement at the Sacramento Convention Center.
Rationale for Recommendation: SMAC is recommending that the City execute an agreement with the Artist Team for the final design and budget for the sculptural art piece. The Artist Team was selected unanimously by the Art in Public Places selection panel for the Convention Center Complex project, pursuant to an open and competitive process. The Artist Team was chosen because they have the ability and experience to complete the artwork project as proposed. The Artist Team will enter into an agreement working closely with architects and staff to fully develop the construction and budget details for the artwork project. The final design is being requested in order to know whether it is feasible for the Artist Team to fabricate and install material within the estimated budget and whether it is safe to structurally integrate the artwork in the area of J and 13th Streets.
Should the final design be approved, staff from APP will return to Council with a request that the Artist Team be authorized to proceed with fabrication, construction, and installation of the artwork. Staff will seek Council approval and authorization that the City Manager or designee execute a second agreement which would be for the fabrication, construction, installation, and purchase of the artwork from the Artist Team. This second agreement would be for an estimated amount not to exceed $880,000.
Financial Considerations: The anticipated total artwork project cost is $1,100,000. The not-to-exceed amount for the agreement for the final design and budget is $220,000. The remaining $880,000 in estimated project costs will be for the fabrication, construction, installation, and purchase of artwork.
Sufficient funding is available (2018 Tax-Exempt Transient Occupancy Tax Revenue Bond Fund, Fund 6330) in the Convention Center Complex Renovation Project (M17100100) to execute the agreement with De La Torre Brothers, Inc.
