Pass a Motion: 1)  authorizing the City Manager or the City Manager’s designee to execute On-Call Professional Services Agreements for Environmental Consulting Services with Geocon Consultants, Inc., Geosyntec Consultants, Inc., Stantec Consulting Services, Inc., and Stratus Environmental, Inc., each for an initial three-year term and up to two additional one-year terms for a total amount not-to-exceed $300,000; and 2) authorizing use of the City Office of Innovation and Economic Development’s Request for Qualifications No.EV00000031 issued June 2019 for environmental consulting services to satisfy the competitive selection requirements for these agreements.

Description/Analysis

 

Issue Detail: On-call Environmental Site Assessment (ESA), Hazardous Materials Testing, and Remediation professional services agreements are established as “best management practices” to provide timely and more efficient services and are well suited for small to medium service requests. City staff will typically assign work on a rotational basis so that consultants are assigned approximately the same value of available work over the agreement term.

 

The Facilities and Real Property Management Division is seeking City Council approval to use the Office of Innovation and Economic Development’s Request for Qualifications (RFQ) No. EV00000031 issued in June 2019 to select consulting firms for environmental services to satisfy the competitive selection requirements for the proposed agreements.

 

The selected firms will assist the Facilities and Real Property Management Division in support of various departments, projects, and programs that have a City-wide impact. The firms provide a number of environmental services including site assessments, hazardous materials surveys, historical and archaeological resources, remediation oversight, coordination with regulatory agencies, and ensuring compliance with relevant environmental rules and regulations.

 

Policy Considerations: The recommendation in this report is in accordance with City Code Chapter 3.64 regarding contracts for professional services.

 

It is also consistent with General Plan Public Health and Safety Policy 3.1.1, Investigate Sites for Contamination, which states that the City shall ensure buildings and sites are investigated for the presence of hazardous materials and/or waste contamination before development for which City discretionary approval is required. The City shall ensure appropriate measures are taken to protect the health and safety of all possible users and adjacent properties.

 

Economic Impacts:  None.

 

Environmental Considerations: The recommended professional services agreements specified in this report do not constitute a project under CEQA because the activities amount to continuing administrative activities under CEQA Guidelines section 15378(b)(2). Additionally, the activities are exempt from CEQA because it can be seen with certainty there is no possibility the activities in question will cause a significant impact on the environment pursuant to CEQA Guidelines section 15061(b)(3).

 

Sustainability: The recommendation in this report is in accordance with General Plan Land Use and Design Element 1.1.4, 2.6.1, and 2.6.5 which relate to facilitating infill development, sustainable development patterns, and reuse of existing structures.

Rationale for Recommendation: The City has an ongoing need for environmental consulting services in the delivery of projects and programs. On September 27, 2016, the City Council passed Motion 2016-0295 authorizing the execution of three-year agreements for on-call professional services related to environmental consulting services. Those contracts expired on September 27, 2019.

 

On June 28, 2019, the Office of Innovation & Economic Development issued a RFQ for on-call ESA, Hazardous Materials Testing, and Remediation Services. The RFQ stated that other departments could also award contracts to firms placed on a qualified list through the RFQ. The City received 15 Statements of Qualifications. The selection committee conducted a review and evaluation of the submittals based on the firm’s qualifications and experience. The Facilities and Real Property Management Division selected the following top ranked firms to enter into an On-Call Professional Services Agreement: Geocon Consultants, Geosyntec Consultants, Stantec Consulting Services, and Stratus Environmental.

 

Financial Considerations: Each agreement will have a not-to-exceed amount of $300,000 for a three-year term. The City may extend the agreement term in writing for additional successive one-year periods, provided that the total agreement term including any such extensions shall not exceed five years.

 

When professional services are required, City staff will prepare a scope, request a proposal, and negotiate a fee. When a cost and schedule are agreed upon, a purchase order will be issued against a fully funded capital improvement project. Professional service providers may have multiple service requests or purchase orders during a given year; however, the aggregate amount of purchase orders may not exceed $300,000 for the term of the agreement. Capital improvement projects must be established and have sufficient funds to issue a purchase order.

 

Local Business Enterprise (LBE): The RFQ required consultants to submit their Local Business Enterprise certification status.  LBE firms were given 5 additional points on the evaluation criteria worksheet.  The following selected firms are Local Business Enterprise: Geocon Consultants and Stantec Consulting Services.
