Description/Analysis

 

Issue Detail: AB 1506 (McCarty) would: 1) establish the Statewide Officer Deadly Force Investigation Division within the Department of Justice (DOJ) to, upon request of a law enforcement agency or District Attorney, conduct an investigation into an officer-involved deadly-force incident, provide written findings, and if applicable, conduct the prosecution of the officer(s) involved; and 2) establish a Police Practices Division within the DOJ to, upon request, review the “patterns and practices” of a local law enforcement agency, and provide recommendations and action items for improvement. In March 2018, Chief of Police Daniel Hahn requested DOJ conduct an independent investigation into the officer-involved shooting death of Stephon Clark. The DOJ completed that investigation on March 5, 2019.

 

AB 2054 (Kamlager) establishes, for three years, the Community Response Initiative to Strengthen Emergency Systems (C.R.I.S.E.S.) Act Grant Pilot Program Act, with the goal of improving emergency responses for vulnerable populations in California, by strengthening, expanding and promoting community-based responses to emergency situations. Grants will fund culturally informed and appropriate responses to immediate emergency situations, as well as in the follow-up. Community-based organizations with a deeper knowledge and understanding of the issues, people, and set of relationships surrounding the emergency are able to provide more effective and cost-efficient services.

 

Policy Considerations: If passed, AB 1506 would provide additional assistance in investigating lethal use of force. Additionally, AB 2054 would provide support for any City efforts to provide non-law enforcement response to 911 calls that don’t involve a crime.

 

Supporting AB 1506 and AB 2054 is in alignment with the City Council approved 2020 State and Federal Legislative Platform. Specifically, the Platform states that the City supports legislation and funding to improve the safety, security, and quality of life for all City residents. This includes:

 

                     Independently investigating, if warranted, any lethal use of force by law enforcement.

                     Increasing transparency of police actions and past conduct and engaging the Legislature on the impact of legislation that shields law enforcement personnel from prosecution.

                     Reducing and preventing gun violence, crime, drug use, and gang violence, and promoting public outreach, engagement and intervention programs.

                     Providing services and facilities for people experiencing a behavioral health or other crisis, including youth, and addressing first responder psychological wellness.

Rationale for Recommendation:  Supporting AB 1506 and AB 2054 is consistent with the City’s 2020 State and Federal Legislative Platform. If passed, these bills would increase transparency and accountability of police actions and could provide resources for a non-law enforcement response to 911 calls.
