Pass a Motion: 1) suspending competitive bidding in the best interests of the City for the reasons set forth below; 2) approving the use of the General Services Administration (GSA) contract with Lenco Industries, Inc. dba Lenco Armored Vehicles (Contract No. GS-07F-169DA) for the purchase of one BearCat armored vehicle in an amount not to exceed $404,521; and 3) authorizing the City Manager or the City Manager’s designee to execute the purchase specified above.

Description/Analysis
Issue Detail: The Department of Public Works, Fleet Management Division, has a customer requirement to purchase an armored vehicle for the Sacramento Police Department.
Policy Considerations: City Code 3.56.230.C provides that competitive bidding shall not apply to bids for supplies or nonprofessional services of $100,000 or more when, upon two-thirds vote, the City Council determines that it is in the best interests of the City to suspend competitive bidding.
Economic Impacts: None
Environmental Considerations: No environmental review is necessary because the recommendations in this report involve the purchase of vehicles and are not considered to be a project in accordance with Section 15378(b)(2) of the California Environmental Quality Act guidelines.
Sustainability: The recommended purchases are consistent with the updated Fleet Sustainability Policy adopted by City Council on December 12, 2017 (Resolution No. 2017-0478).

Rationale for Recommendation: As the federal government’s purchasing agent, General Services Administration connects federal purchasers with the most cost-effective and high-quality commercial products and services. This justification is used to purchase the armored vehicle through GSA Advantage. GSA Advantage sources different government contracts that are not competitively bid; but have substantive cost savings across the board. Overall, the City will save 5% on the purchase when compared with open market prices.
The Sacramento Police Department has received approval to purchase an additional armored vehicle for ballistic protection for officers and citizens during high-risk search warrants, hostage situations, barricaded subjects, and other dangerous circumstances. The armored vehicle will be used as a rescue vehicle to save lives, provide safety for medical personnel treating victims and crisis negotiators at the scene, and provide the ability to safely deliver equipment, supplies, and other necessities during high risk operations.
The Lenco BearCat is the same brand of armored vehicle currently utilized by the Sacramento Police Department as well as surrounding municipalities and agencies. The standardization of this vehicle allows for additional units from the police department and other agencies to be on scene, as officers from the City and other agencies have the necessary knowledge of how to operate them. By purchasing the same brand of armored vehicle, this eliminates the need for additional training and the associated costs on a different type of vehicle.
Additionally, the Lenco BearCat is the only armored rescue vehicle with a 131-inch wheelbase. This allows the compact vehicle to have a tighter turning radius than larger options. The smaller turning radius allows the user to navigate through city streets and traffic with greater maneuverability.
Financial Considerations: The recommended purchase in an amount not to exceed $404,521, will be made from the Department of Public Works Fiscal Year (FY) 2019/20 Operating Budget (Fleet Fund, Fund 6501) and charged to the FY2019/20 Police Measure U MYOP (I80110800) (Measure U Fund, Fund 2401). Sufficient funding exists in the Department’s FY2019/20 Operating Budget and the FY2019/20 Police Measure U MYOP (I80110800) to support the recommended purchase.
Local Business Enterprise (LBE): Lenco Industries, Inc. dba Lenco Armored Vehicles is not an LBE. The minimum LBE participation requirement is waived when the City suspends competitive bidding and utilizes an alternate procurement method to select a vendor.
