Recommendation

Adopt a Resolution: 1) approving adjustments to the citywide Salary Schedule; 2) amending the Employer-Employee Relations Policy (EERP); 3) approving salary increases for the five direct reports of City Council consistent with the management (SCXEA) salary increases for unrepresented employees; 4) approving an amended employment agreement for the City Manager; and 5) authorizing the City Manager or the City Manager’s designee to make minor changes or adjustments to the Salary Schedule and the EERP in order to correct omissions and errors.

Description/Analysis

 

Issue Detail: The California Code of Regulations requires that the City Council adopt the City’s salary schedules at a public meeting (2 CCR § 570.5). This obligation arises whenever salary ranges are changed to ensure that salary rates are transparent and publicly available. These publicly adopted rates are used by California Public Employees’ Retirement System (CalPERS) to determine the appropriate compensation earnable for each City employee when calculating their pension benefit.

 

The specific changes to the City’s Salary Schedule are presented in two versions, a red-lined version of changes to the Salary Schedule as Attachment 1, and a clean copy of the City’s Salary Schedule is included as Exhibit A to the Resolution.

 

The following new classification has been established:

 

                     Police Social Services Administrator

 

In addition to establishing a salary range for the above-mentioned new classification, salary ranges have been adjusted for several unrepresented classifications to include a general wage increase.

 

The proposed Employer-Employee Relations Policy (EERP) amendments are necessary to document new classifications. The specific changes to the EERP are presented in two versions, a red-lined version of text changes to the EERP is included as Attachment 2, and a clean copy of the revised EERP for Council approval is included as Exhibit B to the Resolution.

 

Additionally, the City Council evaluated the performance of five direct reports and conferred with the City’s negotiator on December 11, 2018, during a duly noticed Closed Session. As a result of the performance reviews, the City Manager, City Treasurer, and City Clerk, on their respective anniversary dates in 2018, will receive a 2% increase for cost of living and a 2.5% increase for performance, which increases are additive not compounded.  These compensation adjustments consistent with the City’s salary structure for management employees represented by SCXEA, and do not exceed the salary range for the associated positions.  The City Manager’s employment agreement has also been amended.   The specific amendments to the City’s Managers employment agreement are presented in two versions, a red-lined version showing all changes to the agreement as Attachment 2, and a clean copy of the amendment to the employment agreement executed by the City Manager which is included as Exhibit C to the Resolution.

 

Effective December 22, 2018, the City Auditor and Director of Public Safety and Accountability will receive a 2% increase for cost of living and a 2.5% increase for performance, which increases are additive not compounded. 

The City Auditor and Director of Public Safety and Accountability will also receive a lump sum payment equal to the amount owed from their salary increase due date through December 21, 2018.  The salary ranges for these positions are adjusted accordingly as shown on the City’s Salary Schedule as included as Exhibit A to the Resolution.

 

New salaries for the five reviewed City Council direct reports are as follows:

Policy Considerations: Approval of this action by the City Council is consistent with the City’s legal obligation under the CalPERS law.

 

Economic Impacts:  None.

 

Environmental Considerations: This report concerns administrative activities that will not have a significant effect on the environment and that do not constitute a “project” as defined by the California Environmental Quality Act (CEQA) Guidelines Sections 15061(b)(3) and 15378(b)(2).

 

Sustainability: Not applicable.

Rationale for Recommendation: Approval of this action will establish compliance with the California Code of Regulations §570.5.

 

Financial Considerations: The impacts of any salary increase authorized have are included in the City’s current budget.
