Pass a Motion authorizing the City Manager or the City Manager’s designee to execute Supplemental Agreement No. 2 to City Agreement 2016-1428 with NV5 to provide engineering services for the 3rd Street Relief Sewer, for an amount not-to-exceed $130,000 bringing the agreement’s total not-to-exceed amount to $730,760 and extending the agreement term through December 1, 2020.

Description/Analysis

 

Issue Detail: Staff recommends Council approve Supplemental Agreement No. 2 with NV5 to complete the remaining tasks for bidding and engineering construction assistance, and design and engineering services, required to complete the design of the 3rd Street Relief Sewer Project (Project).  This Project will provide additional wastewater conveyance capacity from proposed development within the Downtown Railyards area; the River District separated sewer area; and from adjacent areas in the Central Business District. 

 

Policy Considerations:  The proposed supplemental agreement exceeds the City Manager’s approval authority, requiring Council approval per City Code 3.64.040.  This work is consistent with the criteria set forth in the DOU Capital Improvement Project Programming Guide to rehabilitate, replace, and expand critical infrastructure to ensure reliability and safety.  

 

Economic Impacts:  None.

 

Environmental Considerations:  Per the California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3), approval of the proposed Supplemental Agreement is exempt from the CEQA, under the general rule that CEQA only applies to actions with potential to significantly affect the environment. Approval of this Supplemental Agreement for additional engineering services will not affect the environment. Appropriate evaluation and documentation of the environmental effects of the project as required by CEQA will be completed prior to future project approval.

 

Sustainability:  Completion of the 3rd Street Sewer Relief Project is consistent with the 2035 General Plan as it supports the City’s goal of rehabilitating the combined sewer system to decrease flooding, outflows, and overflows. 

 

Commission/Committee Action:  Not applicable. 

 

Rationale for Recommendation:   On February 5th, 2016, a Request for Qualifications (RFQ) was advertised on PlanetBids (Q16141311014) inviting interested firms to submit their qualifications to provide plans and specifications, and engineering services during bidding and construction of the Project. Five firms (NV5, Carollo, West Yost, Hatch Mott McDonald, and MRPE) submitted qualification statements (SOQs) on March 3rd, 2016.  NV5 was selected and Agreement (C2016-01428) was approved by Council on November 29, 2016.

 

Additional engineering services were required to accommodate and coordinate the Project design with the design of the City’s Downtown Streetcar Project which will travel along 3rd Street from Capitol Mall Blvd., to H St., and the Railyards Development sewer main which will connect to the Project at H St.  The proposed Supplemental Agreement will allow for completion of Tasks 4, 5, and 6 of the existing scope of work. 

 

Supplemental Agreement No. 2 is necessary because of changes in the design of the Downtown Riverfront Streetcar Project (Streetcar Project).  After 3rd Street pre-design work and the 30% design plans were completed, multiple streetcar alignment modifications occurred which required several subsequent re-evaluations and iterations of the Project design to accommodate new streetcar alignments. These iterations were not included in the original scope of work. Due to these design changes associated with the Streetcar Project, NV5 also performed additional surveying and coordination with representatives of the Railyards Development to confirm the connection point of the 3rd Street sewer main with the railyard’s sewer.

 

Furthermore, Department of Utilities staff requested additional work to ensure the Project does not conflict with the Basin 52 Drainage Master Plan.  Basin 52 serves the majority of the 3rd Street project area and the collection system has been determined to be undersized.  The pumping station is located at 3rd and P Street.

 

Financial Considerations:   The proposed Supplemental Agreement is for an amount not-to-exceed $130,000, increasing the agreement’s original not-to-exceed amount from $600,760 to a new not-to-exceed amount of $730,760.  Sufficient funds are available in the Combined Sewer System Capital program (X14010000) to execute the agreement.
