Pass a Motion authorizing the City Manager or the City Manager’s designee to: 1) execute Supplemental Agreement No. 5 to City Agreement 2017-0137 with Stantec Consulting Services, Inc., for engineering services to complete the McKinley Park Storage Facility Project, Environmental Impact Report, for an amount not-to-exceed $36,755, bringing the agreement’s total not-to-exceed amount to $845,546; 2) ratify Supplemental Agreement No. 4 to City Agreement No. 2017-0137; and 3) reset the City Manager’s administrative authority.

Description/Analysis

 

Issue Detail: Staff recommends Council approve Supplemental Agreement No. 5 with Stantec Consulting Services, Inc. (Stantec), for engineering services to complete the Environmental Impact Report (EIR) for the McKinley Park Storage Facility Project, and additional engineering services to support the EIR.

 

The original agreement (2017-0137) included funding for preparation of an addendum to the Combined Sewer System (CSS) Improvement Plan EIR. In the beginning phases of the environmental review process it was determined by the Community Development Department (CDD) and Department of Utilities (DOU) that the project warranted a project-specific EIR that required additional consultant services to complete the document.   

 

Policy Considerations:  The proposed Supplemental Agreement No. 5, plus the amount of supplemental agreement number 4, exceeds the City Manager’s approval authority, requiring Council approval per City Code 3.64.040.  This work is consistent with the criteria set forth in the Department of Utilities (DOU) Capital Improvement Project Programming Guide to rehabilitate, replace, and expand critical infrastructure to ensure reliability and safety.  

 

Economic Impacts:  None.

 

Environmental Considerations:  On October 9, 2018, the City Council certified (Resolution No. 2018-0401) the environmental impact report (EIR) and adopted the mitigation monitoring program (MMP) that evaluated the physical effects on the environmental from development of the McKinley Water Vault Project. The EIR and MMP were prepared and acted upon in compliance with the California Environmental Quality Act (CEQA).  The current action is an administrative activity associated with the agreement for completion of environmental review and engineering tasks and would not create or cause effects not included in the EIR. None of the circumstances set forth in CEQA Guidelines Section 15162 are present and the EIR and MMP are adequate to identify potential effects and mitigation measures for the project. No further environmental review is necessary.

 

Sustainability:  Construction of the McKinley Park CSS Storage Facility is consistent with the 2035 General Plan as it supports the City’s Long-Term Control Plan to rehabilitate the CSS to decrease flooding, outflows, and overflows. 

 

Commission/Committee Action:  Not applicable.

 

Rationale for Recommendation:  The final EIR required more work than anticipated. Additional preparation was required to address CDD and DOU comments, quality assurance and control, and for support at project EIR meetings to finalize the document.

 

Financial Considerations:   The original not-to-exceed amount of the agreement was $647,736.  The net change by previous supplemental agreements in the amount of $161,055 increased the agreement not-to exceed amount to $808,791.  The proposed Supplemental Agreement No. 5 in the amount of $36,755, would increase the agreement not-to-exceed amount to $845,546.  Sufficient funds are available in the Combined Sewer System Capital Improvement Program (X14010000) to execute the agreement. 

 

There are no General Funds allocated or planned for this project.

 

Local Business Enterprise (LBE):  Stantec is an LBE.

 

Background: On February 3, 2017 the City executed City Agreement 2017-0137 with Stantec Consulting Services, Inc. to provide engineering services for the McKinley Park CSS Facility project’s pre-design phase.

 

On July 25, 2017, Supplemental Agreement No. 1 was approved by Council. This agreement increased the scope from a supplemental EIR, to a project EIR, and for engineering to support the EIR and extended the term of the agreement through April 2018. The not-to-exceed amount increased by $129,343, for a total not-to-exceed amount of $777,079. 

 

On March 21, 2018, Supplemental Agreement No. 2 was executed to change the scope to evaluate a shallow cast-in-place structure, and to extend the term of the agreement through June 2018. There was no change to the not-to-exceed amount of the agreement.

 

On June 2, 2018, Supplemental Agreement No. 3 was executed to extend the term of the agreement through December 2018. There was no change to the not-to-exceed amount of the agreement.

 

On July 31, 2018, Supplemental Agreement No. 4 was executed, with City Manager authority, to modify the scope and budget to reflect the number of comments that were received during the release of the draft EIR. The not-to-exceed amount increased by $31,712, for a total not-to-exceed amount of $808,791.
