Pass a Motion authorizing the City Manager or the City Manager’s designee to execute a Professional Services Agreements with 1st Choice DVBE for an amount not-to-exceed $300,000, for up to four years of Labor Compliance Augmentation and Contract Administration services for construction of Capital Improvement Projects, including but not limited to the Accelerated Water Meter Project.

Description/Analysis

 

Issue Detail: Staff recommends Council approve an agreement with 1st Choice DVBE to provide labor compliance monitoring services for Department of Utilities construction projects.  The Consultant will ensure that the City meets regulatory requirements mandated by City Code. 

 

Labor compliance activities include, but are not limited to, field interviews with employees at the project job site, review of certified payroll and apprenticeship documents, investigation of prevailing wage violation complaints, processing and reconciliation of contractor pay request applications, facilitating the project closeout process, and providing technical assistance and administrative support to staff, and contractors, related to labor compliance.

 

Policy Considerations: City Council approval is required for professional service agreements of $100,000 or more, per City Code 3.64.020.  

 

Section 3.60.180 of the City Code requires the City to monitor its Contractor’s labor force and ensure they comply with all Department of Industrial Relations (DIR), the Department of Labor (DOL), and State of California Department of Transportation (Caltrans) policies and procedures.  

 

Economic Impacts:  None

 

Environmental Considerations: This report concerns administrative activities that will not have a significant effect on the environment and does not constitute a “project” as defined by the California Environmental Quality Act (CEQA) [CEQA Guidelines Sections 15378(b)(5)].

Rationale for Recommendation:  On August 24, 2018, a Request for Proposals (RFP) (P19151131006) was advertised and issued on PlanetBids for labor compliance services by the Department of Public Works. Proposals were submitted by 1st Choice DVBE, Contractor Compliance & Monitoring, Inc., and Silveira Consulting, Inc. All three were short-listed after a scoring and ranking process.

 

A panel of City staff from the departments of Public Works, Procurement and Finance reviewed and evaluated the consultant teams’ written proposals based upon experience, qualifications, labor compliance understanding, and work plan among other factors. All consultant teams were deemed qualified responders to the proposal solicitation process, with the panel ultimately selecting 1st Choice DVBE and Silveira Consulting, Inc. as the top ranked firms. The panel took into consideration the project teams that 1st Choice DVBE and Silveira Consulting, Inc. assembled, availability to perform labor compliance functions, internal quality controls, communication and timely service. 1st Choice DVBE and Silveira Consulting, Inc. were selected to provide the requested services based on their knowledge, expertise, and experience.  

 

Financial Considerations: The proposed agreement is for up to four years, for an amount not-to-exceed $300,000. The total estimated cost for the initial year is $100,000. There are sufficient funds available in the Residential Water Metering Program project (Z14010000) for the costs associated with this agreement. The agreement will be utilized by other Department of Utilities capital improvement projects, and the costs will be allocated to those projects contingent upon budget approval.

 

There are no General Funds allocated or planned for this project.

 

Local Business Enterprise (LBE):  1st Choice DVBE is not an LBE. The minimum LBE participation requirement was waived by the Procurement Services Manager of Finance as staff has determined the waiver is in the City’s best interest as a result of the specialization of the work to be completed.
