Pass a Motion: 1) authorizing the City Manager or City Manager’s designee to execute Supplemental Agreement No. 4 to Contract No. 2017-0635 with Rider Levett Bucknall Ltd. for a not-to-exceed amount of $2,678,730, bringing the total contract amount to $4,813,730 for construction administration services during the construction of the SCC; 2) authorizing the City Manager or City Manager’s designee to execute Supplemental Agreement No.1 to Contract No. 2017-0219 with Rider Levett Bucknall Ltd. (RLB) for a not-to-exceed amount of $754,975, bringing the total contract amount to $2,334,975 for construction administration services of the CCT; and 3) authorizing the deaccession of the site-specific installation titled Skylight on the Terrace (Artwork) by Joseph DiStefano, and an exemption from the appraisal requirements required in the Standard Policies and Procedures of the Art in Public Places Program and the 1992 revised APP Deaccessioning Policy.

Description/Analysis

 

Issue Detail: Staff recommends authorizing the City Manager to execute Supplemental Agreement No. 4 with RLB to provide program construction administration services for the SCC and Supplemental Agreement No.1 with RLB for the CCT project.  RLB was previously selected through a competitive process to serve as the owner’s representative on the SCC and CCT projects.  RLB will administer the project program, monthly reports, monitor the construction buy out period and the project schedule.  In addition, they will lead the coordination efforts for building commissioning, turn-over and occupancy, lead the efforts to manage the procurement of furniture, fixtures and equipment, operational supplies and equipment, and provide technical expertise for both the SCC and the CCT.

The Convention Center East Terrace is slated for demolition and renovation. The Artwork is site specific and was designed into its location. The City agreement with the artists reads: “This does not preclude the City’s right to move the work or remove it from display. For purposes of the application of Civil Code § 987, the Work shall be treated as though it is a work which is part of a building.”

The Artwork has had a life span of 24 years, and the Artwork has shown wear and damage due to years of outdoor exposure and the type of materials. Because of the fragility of the materials, attempts to remove the Artwork would be tenuous and restoration costly if not impossible. Thus, the cost to remove and preserve the work would mean substantial repairs that might change the intent of the work and violate copyright laws.

Therefore, staff is requesting to waive the requirement to obtain an appraisal for the Artwork that cannot physically be relocated or be restored.

The artwork meets three criteria to be deaccessioned set forth in the Deaccessioning Policy Resolution No. 84-765. A work of art may be considered for deaccessioning if one or more conditions such as the following apply:  

                     3. Deaccessioning has been requested by the agency that displays the work.

                     9. It is damaged irreparably, or to an extent where repairs is unreasonable or impractical.

                     11. A suitable place for display no longer exists.

 

Policy Considerations: The improvements to the SCC and the CCT support the following goals and policies of the City’s General Plan:

 

                     ERC 4.1.3 City-Owned Resources.  The City shall enhance the quality of existing City-owned arts and cultural resources and facilities through reinvestment, communications and marketing.

                     ERC 4.1.5  The city shall support renovation and expansion of Convention Center facilities and adjacent supportive infrastructure, including hotels, to attract top tier national and international events.

 

Under City Code section 2.84.130, SMAC has the authority to provide for the nature, selection, and placement of APP artwork purchases.

 

The Sacramento Metropolitan Arts Commission (SMAC) approved the recommendation to deaccession the Artwork on October 8, 2018.

 

The deaccession plan follows the Standard Policies and Procedures of the Art in Public Places (APP) Program and the 1992 revised APP Deaccessioning Policy. The APP Policy and Resolution for Deaccessions requires an appraisal, but due to the inability to save the artwork, it is not financially prudent. Staff is asking that the requirement be waived in this limited instance.

 

Economic Impacts: Not applicable.

 

Environmental Considerations: On June 19, 2018, City Council approved Resolution No. 2018-0252 certifying the Environmental Impact Report and Mitigation Monitoring Plan for the SCC Renovation and Expansion Project. On April 27, 2010, the City Council found the Community Center Theater Renovation project to be exempt from CEQA, citing CEQA Guidelines Section 15302 (Resolution 2010-208).

 

Sustainability: The SCC project will be designed utilizing energy efficient standards and will reduce the carbon footprint contribution, therefore helping meet the City of Sacramento’s sustainability goal. The City is pursuing Leadership in Energy and Environmental Design (LEED) Silver certification with the U.S. Green Building Council for the SCC Renovation and Expansion Project in accordance with City policy LU 8.1.5 LEED Standard for City-Owned Buildings, which requires LEED (Leadership in Energy and Environmental Design) Silver or equivalent standard.  The CCT project will be designed in accordance with City policy LU 8.1.5 and will meet the LEED Silver equivalent standards.

 

Commission/Committee Action:  Not applicable.

 

Rationale for Recommendation: The SCC improvements will enable the facility to remain competitive with convention centers in California.  In addition, the project is expected to bring more jobs, spending, visitors, and hotel stays in Downtown.  Without these improvements, Sacramento’s competitive position is expected to decline with more events and conventions selecting other destinations.

 

Approval of these supplemental agreements are necessary to move forward with the construction phase of the project. 

 

The deaccession of the Artwork meets the goals of both the City and APP Program by providing access for the expansion and construction project of the Convention Center.

 

Financial Considerations: There is sufficient funding available in the Convention Center Complex Renovation Project (M17100100) to fund Supplemental Agreement No. 4 to Contract No. 2017-0635 with Rider Levett Bucknall Ltd. for an amount not to exceed $2,678,730 for the SCC and Supplemental Agreement No.1 to Contract No. 2017-0219 with Rider Levett Bucknall Ltd. for an amount not to exceed $754,975 for the CCT.

 

The removal of the Artwork is included in the Guaranteed Maximum Price construction contract of the SCC that was approved on November 13, 2018.

 

Local Business Enterprise (LBE): The construction contractor for the SCC, AECOM-Hunt Construction Inc. is an LBE firm. RLB is not an LBE.
