Adopt a Resolution: 1) authorizing the City Manager or City Manager’s designee to: a) execute Change Order No. 3 to City Agreement No. 2018-0644 with Sierra National Construction Inc. in an amount not to exceed $277,733, for a new total not-to-exceed amount of $2,891,259; b) increase the expense budget in the Folsom Boulevard Complete Streets Rehabilitation Project (T15135100) by $315,000 (Fund 2032) with a transfer from available fund balance; and c) increase the expense budget in the Folsom Boulevard Complete Streets Rehabilitation Project (T15135100) by $67,000 (Fund 6006) with a transfer from the Wastewater Collector Pipe Replacement Program (X14130600); and 2) resetting the City Manager’s authority to issue Change Orders for City Agreement No. 2018-0644.

Description/Analysis

 

Issue Detail: The Folsom Boulevard Complete Streets Rehabilitation Project includes rehabilitation of the pavement, installation of continuous sidewalk and bike lanes on both sides of Folsom Boulevard, on-street parking where feasible, and installation of new drainage/sewer improvements and street lighting. These improvements will enhance safety on Folsom Boulevard for all modes of travel and facilitate future development activity along the corridor.

 

The project is funded with federal grant funds, local funds, and contributions from adjacent developers.

 

The construction contract was advertised on February 12, 2018, and the contract was awarded on May 8, 2018. City staff has processed two previous change orders related to unforeseen site conditions and cost shared accommodations for upcoming developments on the corridor. These previous change orders have expended the allowable change order authority on the project. One final construction change order is required to pay for additional pavement rehabilitation areas, replace signal detection hardware at the 65th Street intersection, balance out bid quantities and close out the project construction effort.

 

On January 14, 2014, the City Council approved the entitlements for the Campus Crest Apartments (Resolution No. 2014-0017). The fair share funding of improvements identified in the 65th Street Station Area Study was a condition of approval (Section C22 and C28-b) of Resolution 2014-0017.  Appropriation of an additional $315,000 (Fund 2032) of the fair share funding to the Folsom Boulevard Complete Street Rehabilitation Project is consistent with the conditions of approval.

 

Policy Considerations: The requested actions are in accordance with City Code Chapter 3.60 and support the City’s General Plan goals of improving the transportation system, enhancing community livability, and improving public safety. 

 

Economic Impacts:  Change Order No 3. is expected to create 1.11 total jobs (0.64 direct jobs and 0.47 jobs through indirect and induced actives) and create $171,482 in total economic output ($108,086 of direct output and another $63,396 of output through indirect and induced activities).

 

The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to qualify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period.  Actual impacts could differ significantly from the estimates and neither the city of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.

 

Environmental Considerations:

 

California Environmental Quality Act/ National Environmental Policy Act (CEQA/NEPA):  It has been determined that the Folsom Boulevard Complete Streets Rehabilitation Project meets the criteria for a Categorical Exemption pursuant to California Environmental Quality Act (CEQA) Section 15301 (existing facilities) and 15303 (new construction). Since the project will be receiving federal funding, it is also subject to the National Environmental Policy Act (NEPA) and has been approved with a Categorical Exclusion.  There is no substantial evidence that the project will have a significant effect on the environment.

 

Sustainability: This project is consistent with the City’s Sustainability Master Plan goals of enhancing the pedestrian facilities in the public right-of-way, reducing dependence on the private automobile, and encouraging pedestrian and bicycle trips.  Additionally, the project is consistent with the City's Sustainability Master Plan and sustainability targets as it will reduce sanitary sewer outflows and improve system reliability which will reduce energy-intensive maintenance efforts.

 

Commission/Committee Action: None

 

Rationale for Recommendation: Change Order No. 3 is required to compensate the contractor for extra work related to sewer line installation, additional pavement rehabilitation work within the 65th Street and Elvas Avenue Intersections, updated median geometry to accommodate the future 67th Street traffic signal, and to address minor quantity overruns associated with construction changes in the field.

 

Approval of Change Order No. 3 and budget adjustments are required to complete the project. 

 

Financial Considerations: The total estimated project cost of the Folsom Boulevard Complete Streets Rehabilitation Project (T15135100) including Change Order No. 3 is $4,463,775.

 

The transfer of $67,000 (Fund 6006) from the Wastewater Collector Pipe Replacement Program (X14130600) and $315,000 (Fund 2032) from the Fair Share available fund balance to the Folsom Boulevard Complete Streets Rehabilitation Project (T15135100) will bring the total budget of $4,485,671 which is sufficient to execute Change Order No. 3 with Sierra National Construction in the not to exceed amount of $277,733 and cover the remaining costs to complete project construction.

 

There is sufficient funding available in the Wastewater Collector Pipe Replacement Program (X14130600) and in the Fair Share (Fund 2032) available fund balance to support the budgetary adjustments to the Folsom Boulevard Complete Streets Rehabilitation Project (T15135100).

 

There are no General Funds planned or allocated for this project.

 

Local Business Enterprise (LBE): The Folsom Boulevard Complete Streets Rehabilitation Project has federal construction funding and requires conformance with Disadvantaged Business Enterprise (DBE) requirements.  Therefore, the City’s LBE requirements are held in abeyance.  The DBE goal for this project is 9%.  By pledging 4.8% DBE participation Sierra National Construction, Inc. did not meet the goal, however they did fulfill the DBE Good Faith Effort requirement in lieu of the goal.
