Description/Analysis

 

Issue Detail: In accordance with City Code § 2.112.030.C.6, tThe Sacramento Ethics Commission (Commission) seeksproposes to adopt the following guidelines applicable to the imposition offor imposing monetary penalties when adjudicating ethics complaintsfor causes of action brought forward to the Commission under the authority granted to the Commission by City Code § 2.112.030(A)(2).

 

These procedures proposed guidelines are intended to ensure a fair, just, and timely process for the resolution of  ethics complaints submitted to the Commission by creating a clear process for imposing monetary penalties. These considerations will be used by tThe Iindependent Eevaluator will use the guidelines when making recommendations on penalties and for the Commission to consider when adjudicating complaints.

 

These guidelines include general principles and factors to consider in determining a penalty, and a tiered approach to penalties based on the seriousness of the violation. These guidelines They are advisory only, and does not limit the Commission from using its discretion tomay depart from the guidancethem when unusual or egregious circumstances exist.
