Description/Analysis

 

Issue Detail: Kleinfelder, Inc. provides professional engineering support services to the City for compliance with State regulatory requirements for the 28th Street and Dellar closed landfills. While the City still does extensive work with SCS Engineers on landfill gas related projects and improvements, the Department of Public Works Recycling and Solid Waste Division has been using Kleinfelder for the past two years for all groundwater reporting requirements, and to help address the Cleanup and Abatement Order (CAO) for the 28th Street Landfill, issued to the City by the Central Valley Regional Water Quality Control Board (“State Water Board”). City staff is pleased to report extensive progress on addressing the matters in the CAO and this Amendment will help the City continue progress on addressing the CAO and meeting the latest State Water Board requirements outlined in this Council item and attachments.

 

This Supplemental Agreement updates the scope of services and budget of Agreement 2016-0924 with Kleinfelder, Inc. to include the newly required Joint Technical Document (JTD) for 28th Street, as well as the Cannon and Scollan landfill properties. The JTD and all the associated permit requirements from the State Water Board are included as attachments to this Council Item. The Cannon and Scollan landfills were acquired by the City in 2016 and 2017. In addition to addressing the JTD and including Cannon and Scollan in the Cities revised permit for the 28th Street Landfill, this Supplemental Agreement also includes two additional years of semi-annual groundwater monitoring reports required by the State Water Board. 

 

The Supplemental Agreement also extends the agreement for slightly more than two additional years through October 31, 2021, in order to complete the additional work of the new JTD and provide the City with two more years of mandatory Groundwater Monitoring reports.

 

Policy Considerations: The recommendations in this report are in accordance with City Code Chapter 3.64.

Rationale for Recommendation: Kleinfelder Inc. is an industry leader in solid waste and landfill engineering, with historical knowledge and experience of the unique challenges the City faces with meeting groundwater regulatory requirements at the City’s closed landfills. They are also a preferred Consultant of the State Water Board which is issuing requirements to the City under its regulatory authority. These requirements are more extensive than normal due to the CAO and the addition of the recently acquired Cannon and Scollan landfills to the 28th Street Landfill permit.

 

To date, the State Water Board is pleased with the work submitted by Kleinfelder on behalf of the City and, as such, City staff recommends using Kleinfelder to address new requirements from the State Water Board. These requirements are summarized in the State Water Board letter included with this Council Item as Attachment 2. Kleinfelder’s proposal and the Supplemental Agreement to address these requirements are also included with this Council item as Attachment 3.

 

This Supplemental Agreement No. 5 to City Agreement No. 2016-0924 includes funding for the expanded scope of services of this agreement, which is comprised of three new tasks:

 

1. Task 14: Preparing Joint Technical Document (JTD) for the City in order to maintain the City’s Waste Discharge Requirements (WDRs) permit and continuing to address the Cleanup and Abatement Order (CAO) R5-2015-0739

2. Task 15: Data Validation and Lab Coordination.

3. Task 16: Semi-Annual Reporting for the 28th Street Landfill and Dellar Landfills for two years.

 

New tasks will be added as needed using a new Task Order form to define, budget and address any new groundwater regulatory requirements.

 

Financial Considerations: Supplemental Agreement No. 5 to City Agreement 2016-0924 will increase the contract amount by $382,277 for a revised total contract amount not to exceed $865,968, as well as extend the term of the agreement to October 31, 2021. Sufficient funding is available (Solid Waste Fund, Fund 6007) in the Landfill Site Closure (Y14000100, $64,252), Dellar Landfill Closure (Y14000700, $54,252), and the 28th St. Landfill Regulatory Project (Y15000100, $263,773) to execute the supplemental agreement and extend the term for these services through October 31, 2021. 

 

Local Business Enterprise (LBE): Kleinfelder, Inc. is not an LBE.  This agreement was procured through Request For Qualifications (RFQ) Q16014541001 for On-Call Environmental Services.  This RFQ waived the requirement in Appendix A, Section 10: “This Request for Qualifications does not require the 5% participation level.”
