1) Review an ordinance adding Chapter 2.162 to the Sacramento City Code to codify the establishment of the Sacramento Youth Commission; 2) review an ordinance amending Chapter 2.62 of the Sacramento City Code to change the name of the Parks and Recreation Commission to the Parks and Community Enrichment Commission; and 3) pass for publication the ordinance titles as required by Sacramento Charter Section 32(c) to be adopted on April 9, 2019.

Description/Analysis

 

Issue Detail: Last year the Parks and Recreation Department changed its name to the Youth, Parks, & Community Enrichment Department. Also, the City Council and City Clerk desire that the Sacramento Youth Commission be established as a formal commission in the City Code. As a result, staff is bringing forward adding Chapter 2.126 to establish the Sacramento Youth Commission in the City Code and amending Chapter 2.62, to rename the current Parks and Recreation Commission to the Parks and Community Enrichment Commission. No substantive changes to either commission’s powers and duties are being recommended. 

 

Sacramento Youth Commission - The Sacramento Youth Commission was established in 1993 as an advisory body by adoption of a resolution. Over the years, the City Council adopted more resolutions to address the commission’s role through adoption of bylaws and addressed its membership and compensation. The proposed Chapter 2.126 includes the same policies that were enacted by the prior resolutions. This ordinance will allow for the Sacramento Youth Commission’s agenda materials and video recording of meetings to be posted on the City’s website under the City Council’s Meetings and Agendas tab, consistent with other city commissions.  

 

The current number of 22 commissioners is being reduced to 19 primarily because members will no longer appointed by the Council’s Personnel and Public Employees Committee due to the difficulty in scheduling interviews. As a result, there will be no at-large members. Rather, the Mayor will now have three direct appointments and each council member will continue to have two appointments. Having an odd-number total of 19 commissioners is preferred to avoid tie votes. All the existing 19 commissioners can be reappointed. The terms will coincide with the terms of the City Council members, consistent with other commissioners’ terms. The age range at the time of appointment is between 14 and 22, and “youth” is defined as between ages of 14 and 24. 

 

While the City Code provides that for other city commissions city employees are not eligible to serve, the Youth Commission’s prior authorization allowed for such appointments. The new ordinance allows part-time employees to be appointed since many youths participate in the City’s part-time and internship youth employment programs.                   

 

Parks and Community Enrichment Commission - In addition to the name change, revisions to Chapter 2.62 are to make the text of the code sections more precise and consistent with other commissions, to delete references to hearings since tree appeals are no longer considered by the commission, and the provision on initial staggered terms when the commission was reformed in 2012 is no longer needed.

Commission/Committee Action: The proposed ordinances were recommended for approval by the Sacramento Youth Commission and the Parks and Recreation Commission. On March 19, 2019, the Law and Legislation Committee recommended forwarding the proposed ordinances to City Council for approval.

 

Rationale for Recommendation: Codifying the Sacramento Youth Commission will elevate the commission to the same role as other city advisory commissions. Changing the Park and Recreation Commission’s name from “recreation” to “community enrichment” reflects the broader role of the city’s programs managed by the Department.
