Issue Detail: On February 25, 2019, the Department of Public Works, Fleet Management Division issued an Invitation for Bid (IFB) for the purchase of Ford Original Equipment Manufacturer (OEM) Parts and Repairs. Two companies bid on the solicitation, however the same person submitted the bid for both companies, contrary to the bid instructions and section 3.56.130 of the City Code. Because the same person provided the bids for two companies, it is not possible to determine if the bid prices were arrived at independently, without consultation or communication between bidders. Therefore, both bid responses should be rejected as invalid.
Policy Considerations: The recommendations in this report are in accordance with City Code section 3.56.130 regarding the rejection of bids for non-professional service contracts of $100,000 or more.

Environmental Considerations: No environmental review is necessary because the recommendations in this report involve the rejection of bids and this action is not considered to be a project in accordance with Section 15378(b)(2) of the California Environmental Quality Act guidelines.
