Description/Analysis

 

Issue Detail: Each Business Improvement Area (BIA) is required to submit an Annual Report (Report) for Council approval as a prerequisite to Council noticing intent to levy the assessment. The BIA Advisory Boards have prepared the required Reports for Fiscal Year (FY) 2019/20 detailing the proposed assessments and expenditure budgets. A summary of proposed assessments for each district is attached (Attachment 3). The individual Reports are on file with the Public Improvement Finance Division of the Finance Department. Approval is recommended for the Del Paso Boulevard, Downtown Plaza, Franklin Boulevard, Old Sacramento, Sutter, and Stockton Boulevard BIA reports. 

 

Approval of the six resolutions will first approve the associated Report, and then, among other things, set the time and place for the public hearing on the proposed assessment and authorize the City Clerk to publish the Resolutions in the Daily Recorder pursuant to Section 36534(b) of the Streets and Highways Code.

 

Policy Considerations: The recommended action establishes the budget for assessment expenditures ensuring that funds collected for each BIA via business-based assessments are used for the intended purpose: to promote the economic revitalization and physical maintenance of the districts, in an effort to create jobs, attract new businesses, and prevent erosion of existing businesses.

 

Economic Impact: Not applicable.

 

Environmental Considerations:

 

California Environmental Quality Act (CEQA):  Under CEQA Guidelines, the continuing administrative activities of assessment districts and annual proceedings do not constitute a project and are therefore exempt from review [14 Cal. Code Regs. §15378(b)(2) & (5)].

 

Sustainability:  Not applicable.

 

Rationale for Recommendation: The actions in the recommended resolutions are required by the California Streets and Highways Code Division 18, Part 6, Chapter 3 (commencing with Section 36530) and Chapter 4 (commencing with Section 36540) and Sacramento City Code Title 3.

 

Financial Considerations: The proposed expenditures are supported by fees assessed against each business within the BIA. City Code allows for an annual increase of BIA fees based on the most current Consumer Price Index (CPI) data. The CPI - All Urban Consumers for the San Francisco area for February 2019 is 3.50%. Accordingly, fees for Del Paso Boulevard, Downtown Plaza, Franklin Boulevard, Old Sacramento, and Stockton Boulevard BIAs will increase by 3.50% effective July 1, 2019, as shown in Attachment 3.  The Sutter BIA is an exception, the fees do not increase by CPI.

 

The City collects the BIA fees at the time the Business Operations Tax is paid. The fees are then forwarded to the contracted BIA Advisory Board(s) authorized by Council to conduct promotion of the BIA. The proposed BIA expenditures are fully fee supported.  Collection costs are supported by the City. 

 

Individual BIA budgets detailing the expected assessment collections and disbursements are attached as exhibits to the respective resolutions. Detailed budgets for services and programs are included in the Annual Report’s submitted by each of the Advisory Boards, on file with the Public Improvement Finance Division.
