Pass a Motion: 1) authorizing the City Manager or the City Manager’s designee to execute Supplemental Agreement No. 3 to City Agreement No. 2017-1189 with Pace Analytical National to provide additional laboratory services for City landfills in an amount not to exceed $65,000, for a new total not to exceed amount of $160,000, and to extend the agreement to June 30, 2020; and 2) resetting the City Manager’s authority to issue supplemental agreements for City Agreement No. 2017-1189.

Description/Analysis

 

Issue Detail: On October 4, 2017, the Department of Public Works, Recycling and Solid Waste Division executed City Agreement No. 2017-1189 with Pace Analytical National to provide laboratory services for groundwater analysis to address regulatory requirements at multiple City landfill locations.  This agreement was awarded as a result of Request For Proposals (RFP) P17155771002 which received six responses, with Pace Analytical National’s submittal receiving the highest review rating.

 

Staff is requesting the approval of Supplemental Agreement No. 3 to provide additional laboratory services necessary to comply with various requirements from the Central Valley Regional Water Quality Control Board (Water Board).

 

Policy Considerations: Pursuant to Sacramento City Code section 3.64.040, any agreement for professional services that is more than $100,000 requires City Council approval.

Environmental Considerations:

                     

California Environmental Quality Act (CEQA): This report concerns administrative activities and government fiscal activities that do not constitute a “project” and is not subject to the provisions of CEQA (CEQA Guideline Sections 15060(c)(3), 15378(b)(2), and 15378(b)(4)).

Rationale for Recommendation: After the execution of City Agreement No. 2017-1189 on October 4, 2017, the Water Board issued new compliance requirements for three of the City’s closed landfill sites that require the City to perform additional tests.  City staff anticipates the Water Board will issue further requirements for other closed landfills soon.

 

Financial Considerations: Supplemental Agreement No. 3 to City Agreement No. 2017-1189 will increase the not-to-exceed amount by $65,000 for a revised not-to-exceed amount of $160,000 as well as extend the term of the agreement to June 30, 2020.  Sufficient funding is available (Solid Waste Fund, Fund 6007) in the Landfill Site Closure Program (Y14000100) to execute Supplemental Agreement No 3. with Pace Analytical National for additional laboratory services in the amount of $65,000 and cover the remaining landfill site closure requirements.

 

Local Business Enterprise (LBE): Pace Analytical National does not meet the requirements of the City of Sacramento’s LBE Participation Program.  During the Request For Proposals (RFP P17155771002) process in 2017, the awarded agreement was estimated to be less than $100,000 in value and the LBE Participation Program requirement did not apply.  As a result, City staff did not seek a waiver from the Department Director from the LBE ordinance.
