Issue Detail: Staff recommends Council approve an agreement with Larry Walker Associates, Inc. (LWA) for the Combined Sewer System (CSS) monitoring services and regulatory support for Fiscal Year 2019/20, which will include reporting activities through January 2021.
The City of Sacramento owns and operates the CSS, which serves the older portion of Downtown Sacramento. The CSS is regulated under a National Pollutant Discharge Elimination System (NPDES) permit (CSS Permit) (Permit No. CA0079111, Order No. R5-2015-0045) issued by the Central Valley Regional Water Quality Control Board. The goals of the CSS Permit are to protect the water quality of the Sacramento River from CSS discharges, reduce Combined Sewer Overflows into the Sacramento River and to reduce flooding and outflows within the area of the City served by the CSS. The CSS Permit specifies required maintenance and operational requirements, effluent limits, sampling requirements, record keeping and regulatory reporting.
Services provided by this agreement include sample collection, laboratory analysis, regulatory reporting, assistance with permit reissuance, evaluation and optimization of CSS performance, and provision of regulatory expertise. Services may also include support of the sanitary sewer system for evaluating sanitary sewer overflows or other sanitary sewer field support, including sampling collection and analysis.
Policy Considerations: City Council approval is required for professional service agreements of $100,000 or more per City Code 3.64.020.
Economic Impacts: None.
Environmental Considerations: This report concerns administrative activities that will not have a significant effect on the environment and does not constitute a “project” as defined by California Environmental Quality Act (CEQA) [CEQA Guidelines Sections 15378(b)(2 and 5).
Sustainability: The proposed project is consistent with the 2035 General Plan as it supports rehabilitation of the CSS, to provide adequate wastewater collection, treatment, and disposal in the City, and to maintain the systems and facilities to promote and sustain a positive economic climate. Implementation of the NPDES permit requirements ensures that the CSS is operated and maintained in a way that protects the designated uses of the Sacramento River. Additionally, local watersheds and water bodies, including creeks, reservoirs, and the Sacramento and American Rivers and shorelines are protected through compliance with the NPDES permit.

Rationale for Recommendation: On April 18, 2019, a Request for Qualifications (#Q20141311001) was advertised and issued on PlanetBids for CSS regulatory compliance support. On the due date of May 16, 2019, one Statement of Qualification was received from LWA.
Staff reviewed the proposal and based on their knowledge, expertise, and experience, LWA was selected to provide the requested services.
Financial Considerations: The proposed agreement is for an amount not-to-exceed $434,418. As shown in the table below, there are sufficient funds available in MYOP I14120600 (CSS Regulatory Compliance Support) and MYOP I14620100 (Sanitary Sewer Management Plan Engineering/Regulatory Support) to approve the agreement. The funding for MYOP I14120600 is split 50% from the Wastewater (Fund 6006) and 50% from the Storm Drainage (Fund 6011).

Local Business Enterprise (LBE): LWA is not an LBE, but has partnered with an LBE, Stantec Consulting Services, Inc. (Stantec), for this contract to exceed the minimum LBE participation requirement. Stantec will provide monitoring support and analysis of CSS performance services.
