Pass a Motion authorizing the City Manager or the City Manager’s designee to: 1) approve the Fiscal Year (FY) 2019/20 Northern California Regional Public Safety Training Authority (NCRPSTA) budget; 2) suspend competitive bidding in the best interests of the City; and 3) execute an agreement with the NCRPSTA through June 30, 2020 with four optional one-year extensions, for a total not-to-exceed amount of $1,153,635.

Description/Analysis

 

Issue Detail: The Sacramento Police Department (SPD) must renew its membership with the Northern California Regional Public Safety Training Authority (NCRPSTA), a joint powers authority established via City Agreement 2001-137. As outlined in the agreement, the City must pay lease fees to offset its share of the NCRPSTA’s operating expenses.

 

The Sacramento Fire Department, Los Rios Community College District, and SPD currently form the NCRPSTA. Since 2001, the NCRPSTA has been an ideal location for law enforcement trainings as the premises provides office space for all staff, classrooms for students, and dedicated space for a Shooting Range Complex, Live Fire Shoot House, Chemical Agents House, and a Tactical Village for scenario/tactics-based training. In addition, the NCRPSTA allows the use of shared spaces including the track and obstacle course, other classrooms, weight room, mat rooms, a grinder that is used for a multitude of trainings, and a K-9 training facility. An agreement through June 30, 2020, with four optional one-year extensions, will allow the SPD to continue to develop, build, operate, and maintain a regional public safety training college that will provide comprehensive education and training opportunities to safety personnel and students without having to relocate. The SPD operates its Research, Development, and Training Division on the NCRPSTA premises and provides a training program of the highest order to teach how to effectively and professionally serve and protect life and property and enhance the quality of life in the Sacramento region.

 

Policy Considerations: The recommendations contained in this report are consistent with: 1) Sacramento City Code Section 3.56.090 requiring City Council approval to enter into all contracts for supplies or nonprofessional services involving an expenditure greater than $100,000; 2) Sacramento City Code Section 3.54.070(A)(1) allowing for waiver of a non-discrimination in employee benefits clause in contracts, as the contracting party is a sole source and a vetted public entity that is in compliance with applicable state law; 3) paragraph 11 of the NCRPSTA Joint Powers Agreement (City Agreement 2001-137), which states that no member agency shall allocate funds to the NCRPSTA “unless and until” the NCRPSTA’s annual budget has been received and approved by the respective member agency’s governing body; 4) City Code Section 3.56.230(C) allowing the City Council to suspend competitive bidding for any purchase or contract upon a two-thirds vote when the City Council determines it is in the best interests of the City to do so.

 

The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section  E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. This item was published for 10-day review on October 3, 2019.

 

Economic Impacts:  None

 

Environmental Considerations: The proposed activity is not a project pursuant to the California Environmental Quality Act (CEQA), CEQA Guidelines Section 15378(b)(5). The activity is an organizational or administrative activity of governments that will not result in direct or indirect physical changes in the environment and is not subject to CEQA. CEQA Guidelines Section 15060(c)(3).

Rationale for Recommendation: The City’s responsibilities under City Agreement 2001-137 remain in effect until the City withdraws as a member agency or until the agreement is terminated by the NCRPSTA Board of Directors.

 

The SPD has been part of the NCRPSTA since 2001. Entering into an agreement through June 30, 2020, with four optional one-year extensions, with the NCRPSTA allows for uninterrupted training operations and SPD’s ability to continue to maintain a training environment already established. Currently, the SPD Research, Development, and Training Division has published 2019/20 courses listed in the Los Rios Community College District course catalogue. Interruption of services or relocation could jeopardize current student schedules and the SPD’s ability to carry out its training mission. The onsite training provided is required of all law enforcement personnel and meets the regulations of State of California Peace Officers’ Standards and Training pursuant to California Code of Regulations (CCR) Title 11, Division 2.

 

Financial Considerations:  The NCRPSTA lease agreement is fully funded via an externally funded project (EFP #E11006500) and does not require any additional resources from the City’s operating budget.

 

The total not-to-exceed amount for the agreement and extension terms through June 30, 2024, is $1,153,635, which includes $1,128,635 for the annual lease fees and $25,000 for estimated “open classroom” fees, per Attachment C of the agreement.
