1) Adopt a Resolution: a) approving the donation of surplus property from the Convention Center Complex to various 501(c)(3) organizations and government agencies and authorizing the City Manager or City Manager’s designee to execute hold harmless agreements for the transfer of the surplus property; b) authorizing the City Manager or the City Manager’s designee to execute Supplemental Agreement No. 1 to Contract No. 2019-0130 with Geocon Consultants, Inc. for a not-to-exceed amount of $65,000, bringing the new not-to-exceed amount to $157,015 for the Sacramento Convention Center (SCC) Renovation Project; c) resetting the City Manager’s authority to issue supplemental agreements for Contract No. 2019-0130; and 2) adopt a Resolution a rescinding Resolution No. 2019-0049; b) establishing a new multi-year operating project (MYOP) for the Local Hire and Community Workforce Training Program Implementation Project (I02002200); and c) authorizing the City Manager or the City Manager’s designee to transfer $100,000 in General Funds (Fund 1001) from the expenditure budget in the Convention Center Complex Renovation Project (M17100100) to the expenditure budget in the Local Hire and Community Workforce Training Program Implementation Project (I02002200).

Description/Analysis
Issue Detail: As a result of the C3 project, the Convention Center has surplus items that will not be used upon the reopening of the facility. After allowing for internal departments to request said items, several of our non-profit partners and other governmental agencies expressed interest in the items.
Staff recommends the following donations which represent approximate amounts:

The City also entered into an agreement with Geocon Consultants Inc. for an amount of $92,015 for monitoring and testing required by state and federal regulations. Due to the additional work that will be performed, additional daily monitoring and testing is required, and this proposed supplemental agreement in the amount of $65,000 with Geocon Consultants Inc. will cover this work for the SCC.
On February 12, 2019, the City Council approved Resolution No. 2019-0049 that established a MYOP for the Local Hire and Community Workforce Training Program, transferred funds into the MYOP and approved a memorandum of understanding with the Sacramento Employment and Training Agency. The MYOP number that was approved was subsequently assigned to another project. This report recommends rescinding Resolution No. 2019-0049 and adopting a new resolution to establish a new, corrected MYOP number for the City’s expenses related to monitoring the implementation of the Local Hire and Community Workforce Training Program.
Policy Considerations: City Code Section 3.80.030(F) provides that surplus personal property may be donated to any other public agency or charitable, tax-exempt organizations (under Section 501(c)(3) of the Internal Revenue Code) by Resolution of the City Council. In this instance, the recipients (California Auto Museum, Cal Expo, Fairy Tale Town, Sacramento History Museum, Make-A-Wish Foundation, St. John’s Women’s Shelter and Slavic Pentecostal Missionary Church - which will distribute the received surplus to other organizations such as orphanages, senior and rehabilitation centers) all meet these criteria, making them eligible to receive donated surplus items.
The improvements to the SCC support the following goals and policies of the City’s General Plan:
• ERC 4.1.3 City-Owned Resources. The City shall enhance the quality of existing City-owned arts and cultural resources and facilities through reinvestment, communications and marketing.
• ERC 4.1.5 The city shall support renovation and expansion of SCC facilities and adjacent supportive infrastructure, including hotels, to attract top tier national and international events.
The renovation and expansion of the SCC will allow the facility to remain attractive and competitive in the future, while providing a nationally recognized convention venue for residents, visitors and convention attendees. It is also anticipated to generate increased transient occupancy tax (TOT) revenues as more events will likely lead to more hotel night stays and may generate the need for additional hotel development in the downtown core.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): In accordance with CEQA, the City, as “lead agency”, determined that an Environmental Impact Report (EIR) should be prepared for the SCC Renovation and Expansion Project. On June 19, 2018, City Council approved Resolution No. 2018-0252 certifying the Environmental Impact Report and Mitigation Monitoring Plan for the SCC Renovation and Expansion Project.
Sustainability: The SCC project has been designed utilizing energy efficient standards and will reduce the carbon footprint contribution, therefore helping meet the City of Sacramento’s sustainability goal. The City is pursuing Leadership in Energy and Environmental Design (LEED) Silver certification with the U.S. Green Building Council for the SCC Renovation and Expansion Project in accordance with City policy LU 8.1.5 LEED Standard for City-Owned Buildings, which requires LEED (Leadership in Energy and Environmental Design) Silver or equivalent standard.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: The surplus items are no longer serviceable for events at the Convention Center and by donating them to the identified non-profits and governmental agencies, the City not only avoids disposal costs associated with said items, it allows for the reuse of the items in a manner consistent with City Code Section 3.80.030(F).
Approval of Supplemental Agreement No. 1 with Geocon Consultant Inc. is necessary to move forward with the completion of construction for the SCC.
Finally, it is necessary to rescind Resolution No. 2019-0049 and adopt a new resolution to correct the MYOP number for the Local Hire and Community Workforce Training Program.
Financial Considerations: There is sufficient funding in the Convention Center Complex Renovation Project (M17100100) to transfer $100,000 in General Funds (Fund 1001) to the Local Hire and Community Workforce Training Program Implementation Project (I02002200).
There is sufficient funding in M17100100, TOT Revenue Bond Funds - Tax Exempt (Fund 6330) to execute Supplemental Agreement No. 1 (Contract 2019-0130-1) with Geocon Consultants Inc. for a not-to-exceed amount of $65,000.
Local Business Enterprise (LBE): The contractor for the SCC project (AECOM-Hunt Construction) is an LBE firm.
