1) Review an ordinance amending various Chapters and Sections of Title 15 of the Sacramento City Code and creating new local amendments to the new requirements published in the 2019 California Building Standards Code; and 2) pass for publication the ordinance as required by Sacramento City Charter section 32 to be adopted November 19, 2019.

Description/Analysis
Issue Detail: The State of California recently adopted the 2019 California Building Standards Code (Title 24 of the California Code of Regulations). The adoption of the 2019 California Building Standards Code requires amendments to the City Code. These amendments update the City Code to reflect the 2019 California Building Standards Code and make local amendments to the 2019 California Building Standards Code reasonably necessary due to the local climatic, topographical, or geological conditions.
Policy Considerations: Amending the City Code to adopt the building standards in the 2019 California Building Standards Code is required by the State Housing Law (California Health and Safety Code Section 17910 et seq.).
Economic Impacts: Not applicable.
Environmental Considerations: The proposed ordinance is exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15061(b)(3). The activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.

Commission/Committee Action: This item will be reviewed at the City Council’s Law and
Legislation Committee’s meeting on November 5, 2019.
Rationale for Recommendation: State law requires adoption of the 2019 California Building Standards Code. The additional local amendments are reasonably necessary regulations due to the local climatic, topographical, and geographic conditions. Local jurisdictions are required to adopt these local amendments by ordinance in order for them to be in effect.
