Issue Detail: Staff recommends City Council approve Supplement Agreement No. 2 with Apparatus Testing and Engineering, Inc. to provide electrical testing for an additional 40 Department of Utilities (DOU) facilities. These services are necessary to help the City meet current National Fire Protection Agency (NFPA) 70B guidelines that recommend testing low voltage and medium voltage circuit breakers every 3 to 5 years to ensure their safe operation. This testing will determine if the circuit breakers are able to operate per the manufacturer’s specifications.
Policy Considerations: The proposed supplemental agreement exceeds the City Manager’s approval authority, requiring Council approval. This work is consistent with the criteria set forth in the DOU Capital Improvement Project Programming Guide to rehabilitate, replace, and expand critical infrastructure to ensure reliability and safety.
Economic Impacts: None
Environmental Considerations: The current project has been determined to be exempt from the requirements of the California Environmental Quality Act (CEQA), under Section 15301 (Existing Facilities) and 15309 (Inspections). The activities consist of the operation, repair, and maintenance of existing facilities and mechanical equipment involving negligible expansion of use (CEQA Guidelines Section 15301). Additionally, the activities are limited to the inspection (testing) to check for performance of an operation, or quality or safety of a project (CEQA Guidelines Section 15309). The activity will not result in any direct or indirect physical effects on the environment. These types of maintenance projects were assumed and evaluated for cumulative impacts within the 2035 General Plan Master Environmental Impact Report (EIR).
Sustainability: The proposed project is consistent with the 2035 General Plan, Goal U1.1, for the City provide and maintain efficient, high-quality public infrastructure facilities and services throughout the City. This project will improve infrastructure reliability by ensuring that electrical infrastructure is not prone to failure during normal operation of our facilities.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: On March 7, 2018, a Request for Proposals (RFP) (P18141311006) was advertised on PlanetBids for electrical testing of various DOU facilities. On the due date of March 29, 2018, one proposal was received from Apparatus Testing and Engineering, Inc. City staff reviewed the proposal and selected Apparatus Testing and Engineering, Inc. to provide the electrical testing services. Since then the firm has provided exceptional service and value to the City in their work testing circuit breakers at DOU facilities.
The proposed supplemental agreement allows for the testing of additional DOU facilities to improve their reliability. In addition, the consultant will set the circuit breakers and relays per the recommendations of the electrical study conducted by DOU. This will further enhance the facilities by preventing unnecessary outages of equipment.
Financial Considerations: The original not-to-exceed amount of the agreement was $370,500. The proposed Supplemental Agreement No. 2 in the amount of $350,000 would increase the agreement not-to-exceed amount to $720,500. There is sufficient funding in the Fiscal Year 2019/20 Department of Utilities Operating Budget to execute the agreement.
There is no impact to the General Funds for this project.
Local Business Enterprise (LBE): Apparatus Testing and Engineering, Inc. is not an LBE but has partnered with United Rentals for this project to exceed the minimum LBE participation requirements. United Rentals will provide power generators.
