Adopt a Resolution: 1) authorizing the City Manager, or the City Manager’s  designee, to a) apply for State of California Wildlife Conservation Board (WCB), 2019 Lower American River Conservancy Program funds, for up to the maximum amount of $400,000 for the Cordova Creek Naturalization Phase II Design (Project); and if awarded, b) accept state funds in the amount awarded by the WCB by executing the Grant Agreement and any subsequent modifications; and c) establish an operating grant for the Project (G14140500), including revenue and expenditure budgets in the Habitat Management Element (HME) Fund (Fund 7104), for the amount awarded in G14140500; and 2) rescinding Resolution No. 2019-0259

Description/Analysis

 

Issue Detail: On June 25, 2019, the City Council approved Resolution No. 2019-0259 allowing the City-County Office of Metropolitan Water Planning (CCOMWP, also known as the Water Forum) to apply for State of California Wildlife Conservation Board (WCB), 2019 Lower American River Conservancy grant funding. The resolution did not include language required by the WCB. The attached resolution includes the proper language and will replace Resolution No. 2109-0259.

 

Policy Considerations: Resolution 2018-0235, Section 11.1, requires City Council approval to accept grant funding, establish a grant project and appropriate grant funding when the award is in excess of $100,000.

 

Economic Impacts:  None.

 

Environmental Considerations:

 

California Environmental Quality Act (CEQA): Actions requested in this staff report relate to funding mechanisms that do not constitute a project as defined by the CEQA [CEQA Guidelines Section 15378 (b) (4)].  Project activities that would occur in the event grant funding is received, would be subject to subsequent CEQA review.

 

Sustainability: Preserving the recreational and aesthetic values of the lower American River is a fundamental element of the Water Forum Agreement, which is supported by the City’s General Plan Goals Water Quality Protection (E.R. 1.1).

 

Commission/Committee Action: None.

 

Rationale for Recommendation: The WCB requires additional language be included in grant resolutions adopted by Council. The Resolution attached includes the required language and replaces Resolution 2018-0259.

 

Financial Considerations: If awarded, the Grant Agreement of up to $400,000 will cover the Project costs and no General Fund support is needed. The Water Forum may provide 20% in matching funds, not to exceed $80,000 from the Habitat Management Element (HME) Fund (Fund 7104).

 

Local Business Enterprise (LBE): LBE does not apply. If awarded, City procurement policies will be adhered to in the acquisition of goods and services related to this Grant Agreement.
