Adopt a Resolution authorizing the City Manager or the City Manager’s designee to: 1) execute Supplemental Agreement No. 1 to City Agreement 2017-0551 with Underwater Resources, Inc., to extend the underwater diving and ROV contract for an additional amount not-to-exceed $150,000, bringing the agreement’s total not-to-exceed amount to $550,000; 2) execute Supplemental Agreement No. 1 to City Agreement 2017-0583 with Tidal Marine Construction, Inc., to extend the underwater diving and ROV contract for an additional amount not-to-exceed $150,000, bringing the agreement’s total not-to-exceed amount to $550,000; and 3) transfer $150,000 from the Water Fund available fund balance (Fund 6005) to the Fiscal Year (FY) 2019/20 Department of Utilities (DOU) Operating Budget.

Description/Analysis

 

Issue Detail: Staff recommends Council approve Supplemental Agreement No. 1 with Underwater Resources, Inc. and Supplemental Agreement No. 1 with Tidal Marine Construction, Inc., to extend the contracts for an additional not-to-exceed amount of $150,000 per contract for a total not-to-exceed amount of $550,000 per contract in order to continue supporting the underwater diving needs for the water system.

 

The City of Sacramento has water facilities and pipelines that require underwater diving and ROV services for investigation, cleaning, and repair. They include two river intakes, eleven reservoirs, a Ranney Collector well, and more than 150 miles of transmission mains. Annual underwater maintenance is required at the intakes of both treatment plants where twice a year the facility side of the screens are cleaned. When deficiencies are noticed, additional cleaning from the river side of the screens or minor repairs may be required.

 

Policy Considerations:  The proposed supplemental agreements exceed the City Manager’s approval authority, requiring Council approval.  This work is consistent with the criteria set forth in DOU Capital Improvement Project Programming Guide to rehabilitate, replace, and expand critical infrastructure to ensure reliability and safety.  

 

Economic Impacts:  None.

 

Environmental Considerations:  Per the California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3), approval of the proposed Supplemental Agreement is exempt from CEQA, under the general rule that CEQA only applies to actions with potential to significantly affect the environment. Approval of these Supplemental Agreements for additional engineering services will not affect the environment. Work to be conducted under the agreements has been determined to be exempt from CEQA pursuant to CEQA Guidelines Sections 15301 and 15309 (Existing Facilities and Inspections). The work consists of the operation, repair, maintenance and minor alteration of existing facilities and mechanical equipment and inspections to check for performance of an operation, or quality, health, or safety of a project. 

 

Sustainability:  The proposed projects are consistent with the 2035 General Plan as they improve infrastructure reliability and sustainability by providing supporting services that help continue operations and improve operations of various facility systems

 

Commission/Committee Action:  Not applicable.

 

Rationale for Recommendation:  A Request for Qualifications (RFQ) (Q17141311016) was advertised on December 8, 2016. Tidal Marine Construction, Inc. and Underwater Resources, Inc. were selected and awarded contracts by Council on April 25, 2017.  The contracts were set for 3-year terms, sunsetting in April of 2020. Staff anticipates advertisement of a new RFQ and council approval of on-call contracts within the next six months for future underwater diving and ROV services to begin when the current agreements sunset.

 

Most of the current approved not-to-exceed budget has been expended for both contracts, due to unique conditions at each Water Treatment Plant requiring work above and beyond typical expected underwater dive services as well as delays associated with river flows and safe conditions for the divers to do their work within the river. The sediment removal efforts at the SRWTP intake is an example of diving work above and beyond typical services. A large pilot project to remove sediment in 2018 required divers for three weeks, full time. A second effort will be completed by the end of 2019 due to the success of the pilot. 

 

Financial Considerations:   The original not-to-exceed amount of each of the on-call agreements was $400,000. The proposed Supplemental Agreement No. 1, for both firms, in the amount of $150,000 will increase the on-call agreement not-to-exceed amount to $550,000 for each contract. Services under these agreements are intended to be used to fill needs when demand warrants. Currently, there is a need for services at the Sacramento River Water Treatment Plant Intake for sediment removal in the amount of $150,000. Staff is recommending a budget transfer from the Water Fund available fund balance (Fund 6005) of $150,000 to the DOU FY 2019/20 Operating Budget. If additional services are needed in FY 2019/20, funding will be identified in the approved DOU Operating budget. Funding of the on-call agreements in future fiscal years will be subject to the availability of sufficient funds for the applicable fiscal year.

 

There are no General Funds allocated or planned for this project.

 

Local Business Enterprise (LBE):  Tidal Marine Construction, Inc. and Underwater Resources, Inc. are not LBE’s.  The minimum LBE participation requirement was waived by the Director of Utilities as staff has determined the waiver is in the City’s best interest, due to the lack of qualified local vendor availability.
