Pass a Motion: 1) suspending the competitive-bidding requirement for a reimbursement/credit agreement between Beazer Homes Holding Corporation and the City relating to public improvements identified in the Amended Willowcreek Financing Plan/Nexus Study; and 2) authorizing the City Manager or the City Manager's designee to execute that agreement on the City's behalf.

Description/Analysis

Issue Detail: Beazer Homes Holding Corporation (Developer) is in the process of developing approximately 80.3 acres of land north of West El Camino Avenue, east of Orchard Lane, south of Interstate 80, and west of the Natomas Main Drainage Canal in the Willowcreek area of the City known as the River Oaks/Cove project (Project). A map showing the location of the Project is provided in Attachment 2 of this report.

Development of the Project requires construction of roadway facilities included in the Amended Willowcreek Financing Plan/Nexus Study, dated September 29, 1997 (Finance Plan). The City and Developer wish to enter into a reimbursement/credit agreement (Agreement) to reimburse the Developer for the cost of a portion of Orchard Lane from Willowcreek Fees collected pursuant to the Finance Plan. City Code requires that the Developer use competitive bidding when awarding contracts, however Section 3.60.170 of the City Code states that compliance with competitive bidding may be excused if the City Council determines, by a two-thirds vote, that excusing compliance is in the C...
