Pass a Motion: 1) authorizing the City Manager or the City Manager’s designee to execute Supplemental Agreement No. 1 to Contract No. 2019-0833 with Enovity, Inc. for a not-to-exceed amount of $76,644, bringing the total contract amount to $115,844 for the Community Center Theater (CCT) Renovation Project; and 2) resetting the City Manager’s authority to issue supplemental agreements for Contract No. 2019-0833.

Description/Analysis

 

Issue Detail: Renovation of the CCT will address compliance with Americans with Disabilities Act (ADA) requirements, improve patron experience including better sound and acoustics, and enhance theater operations and functionality. These renovations will address long-standing deficiencies and will enable the building to host more events in the future.

 

The City entered into an agreement with Enovity, Inc. for an amount of $39,200 for a very limited Commissioning Authority to verify the building automation system (BAS) sequence of operation for the heating ventilation and air conditioning (HVAC) system only. Due to required changes during construction and the importance of commissioning, a full scope of commissioning to add staff and additional building systems will be needed to ensure the building is fully operational, and this proposed supplemental agreement in the amount of $76,644 with Enovity, Inc. will cover this work for the CCT.

 

Policy Considerations: The improvements to the CCT support the following goals and policies of the City’s General Plan:

 

                     ERC 4.1.3 City-Owned Resources. The City shall enhance the quality of existing City-owned arts and cultural resources and facilities through reinvestment, communications and marketing.

                     ERC 4.1.5 The city shall support renovation and expansion of Convention Center facilities and adjacent supportive infrastructure, including hotels, to attract top tier national and international events.

 

Economic Impacts: The CCT construction contract requires compliance with the approved Community Workforce and Training Agreement (CWTA), which requires local hiring and allow for targeted employment opportunities for Sacramento residents.

 

                     Environmental Considerations:

 

California Environmental Quality Act (CEQA): On April 27, 2010, Council found the CCT Renovation Project to be exempt from CEQA, citing Section 15302, which provides that projects involving replacement or reconstruction of existing structures and facilities are exempt from CEQA. (Resolution No. 2010-0208).

 

Sustainability: The CCT project will be designed in accordance with City policy LU 8.1.5 and will meet the LEED Silver equivalent standards.

 

Commission/Committee Action: Not applicable.

 

Rationale for Recommendation: Approval of Supplemental Agreement No. 1 with Enovity, Inc. is necessary to move forward with the completion of construction of the CCT.

 

Financial Considerations: Sufficient funding is available in the Convention Center Complex Renovation Project (M17100100) to execute Supplemental Agreement No. 1 (Contract 2019-0833-1) with Enovity, Inc. for a not-to-exceed amount of $76,644.
