Recommendation: Adopt a Resolution: 1) authorizing the City Manager or the City Manager’s designee to execute Supplemental Agreement No. 5 to City Agreement No. 2015-0576 in an amount not to exceed $317,710 for a new total contract amount not to exceed $1,236,541 with Drake Haglan & Associates (recently acquired by Dewberry Engineers Inc.) for the Auburn Boulevard at Arcade Creek Bridge Replacement Project (T15145300); 2) authorizing the City Manager or the City Manager’s designee to execute an Agreement with the County of Sacramento in an amount not to exceed $1,200,000; 3) authorizing the City Manager or the City Manager’s designee to increase the revenue and expenditure budgets in the Auburn Boulevard at Arcade Creek Bridge Replacement Project (T15145300) by $1,200,000 (CIP Reimbursable Fund, Fund 3702); 4) authorizing the City Manager or the City Manager’s designee to transfer $315,000 (Major Street Construction, Fund 2007) from the expenditure budget in the State and Federal Grant Match Program (T15007200) to the expenditure budget in the Auburn Boulevard at Arcade Creek Bridge Replacement Project (T15145300); and 5) resetting the City Manager’s authority to issue change orders for City Agreement No. 2015-0576.

Description/Analysis

 

Issue Detail: The Auburn Boulevard at Arcade Creek Bridge Replacement Project will replace the existing structurally deficient and functionally obsolete bridge over Arcade Creek. The new bridge will be widened to accommodate standard bike lanes, lane widths, and sidewalks.

 

The project will enhance safety on Auburn Boulevard by improving pedestrian and bicycle connectivity and increasing the roadway lane widths to meet City standards. Located on the city’s boundary, the project includes the construction of improvements within both the County of Sacramento and the City of Sacramento limits.

 

The project is funded primarily through the federal Highway Bridge Program (HBP) with matching local funds. Drake Haglan & Associates was selected in 2015 to provide preliminary engineering, environmental documentation, and final design services for the project. The federal HBP program only funds replacement of existing bridge elements and does not cover capacity improvements. The intersection of Auburn Boulevard and Winding Way, however, currently operates at a poor level of service (LOS).  During the design process and through interagency coordination, the City and County of Sacramento recognize that an addition of a left-turn lane from Auburn Boulevard to Winding Way will significantly improve the operations and safety at the intersection. The County recognizes the benefits of constructing the left-turn lane and is willing to share in the costs of the improvements.

 

On July 16, 2019, the County Board of Supervisors approved an Agreement (County Contract No. 81531) in an amount not to exceed $1,200,000 to cover the estimated additional non-federally eligible costs. City Council approval is needed to execute the Agreement with the County.

 

Approval of transfer of funds in the amount of $315,000 and the Supplemental Agreement No. 5 with Drake Haglan & Associates (recently acquired by Dewberry Engineers Inc.)  will allow the project design and environmental documentation efforts to move forward to complete the project.

 

Policy Considerations: The action requested supports the City’s General Plan goals of improving the transportation system, expanding public safety, achieving sustainability through reduced dependence on the private automobile, and enhancing livability and economic vitality. Per City Code Section 3.64, City Council approval is required for approval of agreements more than $100,000.

The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section  E.2.d) mandate that unless waived by a two-thirds vote of the City Council, all labor agreements and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. This item was published for 10-day review on January 23, 2020 as required.

Economic Impacts:  None.

 

Environmental Considerations:

 

California Environmental Quality Act and National Environmental Policy Act (CEQA/NEPA):  The approval of Supplemental Agreement No. 5 and the Agreement with the County of Sacramento is not considered a project as defined by Section 15378 of the California Environmental Quality Act guidelines.  The recommended action involves no physical construction and has no potential to cause significant impact to the environment.

 

The project will undergo environmental analysis in conformance with the CEQA and NEPA.

 

Sustainability: This project is consistent with the General Plan goals of balancing community, social, environmental, and economic goals when modifying streets, roads, bridges, and other public rights-of-way and also by enhancing pedestrian facilities to encourage bicycle and pedestrian trips with increased connectivity along Auburn Boulevard to the trails along Arcade Creek.

Rationale for Recommendation: The Auburn Boulevard at Arcade Creek Bridge Replacement Project will replace the existing structurally deficient and functionally obsolete bridge over Arcade Creek. The new bridge will improve safety and operations and add bike lanes and sidewalks.

 

The City Council approval is needed to transfer funding in the amount of $315,000 and to execute the Supplemental Agreement No 5 with Drake Haglan & Associates (recently acquired by Dewberry Engineers Inc.)   in order to proceed with project design and environmental documentation efforts to allow the project to be ready to advertise for construction.

 

City Council approval is also needed to execute the Agreement with the County of Sacramento in the amount not to exceed $1,200,000 to cover the estimated additional non federally eligible costs which includes implementation of a left turn lane at Auburn Boulevard to Winding Way.

 

Financial Considerations: The total estimated project cost of the Auburn Boulevard at Arcade Creek Bridge Replacement Project (T15145300) for Preliminary Engineering and Design is estimated to be $1,828,776.

 

Approval of the transfer of $315,000 (Fund 2007, Major Street Construction) from the State and Federal Grant Match Program (T15007200)  will bring the total budget to $1,828,776, which is sufficient to execute Supplemental Agreement No. 5 with Drake Haglan & Associates, Inc. (recently acquired by Dewberry Engineers Inc.) in the amount not to exceed $317,710 and complete the preliminary engineering, environmental documentation and design phases of the project. 

Final design and further negotiations with Caltrans will determine the full amount of federal funding available and total costs. Construction funding for the project is intended to be a combination of federal Highway Bridge Program funds, the Cost Sharing Agreement with County of Sacramento, and local transportation funds.

Sufficient funding is available in the State and Federal Grant Match Program (T15007200) to support the $315,000 (Fund 2007, Major Street Construction) transfer to the Auburn Boulevard at Arcade Creek Bridge Replacement Project (T15145300).

 

Under the Agreement with the County, reimbursement of the $1.2 million will not occur until the project is completed, requiring the City to front the payments to the contractor.

 

There are no General Funds planned or allocated for this project.

 

Local Business Enterprise (LBE): This is a federally-funded project.  Disadvantaged Business Enterprise (DBE) project participation requirements apply.  LBE rules are held in abeyance.  The contract award will comply with all federal DBE participation requirements. Drake Haglan & Associates (recently acquired by Dewberry Engineers Inc.)  has pledged 18.29% DBE project participation, exceeding the 9.00% DBE goal set for this project.
