Pass a Motion authorizing the City Manager or the City Manager’s designee to execute an agreement with the Sacramento Area Council of Governments (SACOG) for the repayment amount of $1,550,000 through the Tier 3 Loan Program to be repaid as set forth herein and as in the letter agreement attached hereto and marked Exhibit “A.”

Description/Analysis

 

Issue Detail: On May 5, 2020, the City Council approved the construction contract award for the Meadowview Road Complete Street Project at $8,052,711 and the budgetary adjustments needed (Resolution No. 2020-00390). In order to fill a funding gap, staff requested the Sacramento Area Council of Governments (SACOG) advance additional federal funds to meet the construction schedule through a Loan Program. In order to avoid project delay, the contract was awarded while the agreement was being completed. As part of the previous approvals by the City Council, budgetary adjustments were made contingent upon subsequent approval to execute the loan agreement with SACOG which now requires action.  The financial terms are described in the letter agreement (Exhibit A). 

 

Policy Considerations: The action requested supports the City’s General Plan goals of improving the transportation system, expanding public safety, achieving sustainability through reduced dependence on the private automobile, and enhancing livability and economic vitality. The Project provides much needed improvements to the bicycle and pedestrian facilities for continuous mobility and connectivity for pedestrians, bicyclists, vehicles, and transit.

 

Economic Impacts:  None.

 

Environmental Considerations:

 

California Environmental Quality Act (CEQA) / National Environmental Policy Act (NEPA): The City Council approved a Mitigated Negative Declaration (MND) for the Meadowview Road Streetscape Project in compliance with CEQA on August 8, 2017 (Resolution No. 2017-0313). Following adoption of the MND, Staff filed a Notice of Determination with the Sacramento County Clerk on August 10, 2017. The current action consists of steps to implement the project that was approved and is consistent with the analysis contained in the adopted MND. No further environmental review is required.

 

The Project is funded in part by federal funds. As a result, the proposed Project is also subject to NEPA requirements. On February 6, 2018, Caltrans approved a Categorical Exclusion for the Project pursuant to the requirements of NEPA.  The Sacramento Housing and Redevelopment Agency (SHRA) received NEPA approval through the US Department of Housing and Urban Development for the CDBG funds allocated to this Project.

 

Sustainability: This Project is consistent with the City’s General Plan goals for the design of complete streets that enable safe access for all users (i.e., pedestrians, bicyclists, motorists and transit riders) of all ages and abilities. Complete streets are characterized by a comprehensive, integrated, and connected network that incorporate sustainable designs minimizing heat island effects through the incorporation of shading street trees along sidewalks and medians.

Rationale for Recommendation: Due to limited availability of local transportation funds to fund the construction, City staff requested SACOG advance additional federal funds to meet the construction schedule through SACOG’s Loan Program. The financial terms are described in the letter agreement (Exhibit A). On May 5, 2020, the City Council approved the construction contract award for Meadowview Road Complete Street Project at $8,052,711 and the budgetary adjustments needed in advance of the executed agreement (Resolution No. 2020-00390).

 

The City Council approval is needed to execute the agreement with SACOG.

 

Financial Considerations: The total estimated cost of the Meadowview Road Complete Street Project (T15145500), including engineering, right of way acquisition, construction and construction management is $11.3 million.

 

The City prepared an agreement with SACOG for a Tier 3 Loan for federal funds in the amount of $1,550,000 with a plan for repayment.  The City’s proposed reimbursement plan will come through the successful granting of $1,550,000 of construction funds from the 2020 federal funding cycle. In the event the City is unsuccessful in funding the construction of the Meadowview Road Complete Street Project (T15145500) through the 2020 federal funding cycle, then the City and SACOG will establish a subsequent repayment plan that considers future grant programming or the commitment of City local funds. City Council approval is needed for approval of this loan agreement.

 

There are no General Funds planned or allocated for this project.
