Description/Analysis

Issue Detail: The Water Forum was formed in April 2000 to facilitate discussions regarding water use on the American River. Although the current agreement is in effect until December 31, 2030, the Water Forum Coordinating Committee has asked staff to begin renegotiations now. The original agreement was written with the environmental conditions and knowledge available twenty years ago. Conditions have changed and parts of the current agreement are outdated.

Policy Considerations: City Council approval is required for contracts of $250,000 or more. This action is consistent with Chapter 3.56.090 of the Sacramento City Code and existing policy regarding professional service agreements.

Economic Impacts:  None.

Environmental Considerations:

California Environmental Quality Act (CEQA): Continuing administrative activities do not constitute a project and are therefore exempt from CEQA review [CEQA Guidelines § 15378(b)(2) and (b)(4)].

Sustainability: None,

Commission/Committee Action: None,

Rationale for Recommendation: On May 6, 2020, the City-County Office of Metropolitan Water Planning (CCOMWP, also known as the water forum) issued a request for qualifications (RFQ) (Q20804101001) seeking Water Forum Agreement Facilitation Services. One response was received from Consensus Building Institute, Inc. The proposal was deemed responsive.

Financial Considerations: The proposed agreement is for a not-to-exceed amount of $485,603 with an initial term of one year and an option to extend for one additional one-year term. The agreement will be funded by CCOMWP Water Forum Successor Effort (WSFE) (Fund 7103) and Habitat Management Element (HME) (Fund 7104).

There will be sufficient funding available in the Fiscal Year (FY) 2020/21 CCOMWP operating budget with a transfer from available fund balance from WSFE Fund (Fund 7103).  See funding breakdown in the table below.
