Description/Analysis
Issue Detail: On June 1, 2020 City Council adopted Resolution No. 2020-0153 proclaiming the existence of a local emergency and imposing a curfew due to large demonstrations protesting the death of George Floyd by Minnesota Police Officers resulting in instances of violence by some of the protestors that demanded a high level of local resources to address, putting not only other protestors who were complying with lawful orders at risk, but also the members of the public and law enforcement. On June 6, 2020, City council adopted Resolution No. 2020-0164, terminating the emergency order imposing the curfew.
Since the termination of the curfew order, the criminal behavior and violence have remained abated. Therefore, at this time, there is no longer a necessity to continue the local emergency relating to the civil unrest.
Policy Considerations: Sacramento City Code chapter 2.116 empowers the City Council of the City of Sacramento, California, to proclaim the existence of a local emergency under certain conditions. California Government Code section 8634 also empowers the City Council to promulgate orders and regulations necessary to provide for the protection of life and property during a local emergency, including orders or regulations imposing a curfew within designated boundaries where necessary to preserve the public order and safety. California Government Code section 8630 and Sacramento City Code section 2.116.060 empower the City Council to both declare and terminate a local emergency.
